From the NICS reply, it sounds like NICS had you under non-immigrant alien, such as student, visitor, exchange scholar etc, hence the denial. After they've updated your status to GC status, you are OK to go. Not sure your status before applying for GC. Personally I don't think 90 days have anything to do with it; it's just coincident.

Get CHL and it will save you a lot more trouble. Even then, some FFL will insist to check NICS, which sometimes may cause you some delay.

My FFL at NW Houston only charges $10. PM me if you need the information.

Of course I cannot be sure, but I think it does have to do with the zeroing of ones residency clock once a physical G/C is issued. I got that in hand and therefore was a legal resident and technically A-OK to purchase back in Sep. I also had documents proving I had been here over 90 days, had a state driving licence, my ssn # etc. Officially I was 'here for good' when I was first denied even though I could meet all of the listed requirements. I have always been here under an immigrant visa and was never here as a student, worker, visitor &c and given the comments by other folks here about their initial problems and the way that this has played out in my case I'm pretty happy with the reasoning discussed as to the hold up. Anyway hopefully this won't be something that I'll need to worry about in the future. My CHL paperwork was filed with Austin a few days ago and I can't see myself making another purchase before that turns up (April maybe?). Nevertheless $10 is twice as good as $20 and so I'll keep that in mind. Thank you. In this case my man certainly earnt the extra though IMO

Like I said, even with CHL, some FFLs still check NICS for all GC holders, which may cause some delay for you. just keep that in mind. I learned it in a hard way - twice. This is why I only deal with my FFL now and buy online.

Ok, understood. I bought this one online and I expect that's what I'll do in the future (I saved over $400 by not buying over the counter inc the no sales tax saving). Shame really, I wouldn't have minded showing my face in the local gun shop now and again (but not enough to swallow that sort of markup!)

That's what they told me at the gun store - whether it's correct technically or not, I couldn't say - but I filled out the paperwork again more than 90 days after the date of issuance on my GC and it went through, so who knows

IIRC, there was a very recent change (3 months or less) in how the ATF interpreted non-citizen purchases. How they handled you back then may be very different from how they would handle it now.

...good that TX CHL exempts us from NICS...a non-citizen who's gotten a CHL wouldn't be bumped back when he gets his green card because they wouldn't be calling NICS on purchases, right???

there should be a memo on atf's web site, but I've seen it posted elsewhere. Basically, it says that showing proof of 90 days
residency (usually utility bills) is no longer required.
