Boris Miles found not guilty

A fury found Boris Miles not guilty in Houston Thursday on charges of unlawful carry and deadly conduct.

You may recall that in 2007 he displayed a handgun in two incidents where the threatened people and engaged in some other odd behavior.

It's interesting that he was charged with UCW. He has a CHL. One of the incidents occurred in Toyota Center during a Rocket game, possibly in a bar, which is a 46.035 violation; and both of them were also intentional failure to conceal under 46.035.

Miles's defense argued that the charges were political payback. Miles used to be a Democratic state representative.

"It feels like the state didn't provide us enough impartial evidence," said jury foreman Forrest Peugnet. "They just didn't fulfill the burden of proof."

Although he walked, I would be surprised if this little episode cost him less than 20 grand.

seems like he was charged with the wrong crime. But the prosecution would still have to prove it.

The UCW charge in this case leads me to a question about PC 46.15(b)(6), which is the clause that allows a CHL holder to carry a concealed handgun:

(b) Section 46.02 does not apply to a person who:
(6) is carrying a concealed handgun and a valid license issued under Subchapter H, Chapter 411, Government Code, to carry a concealed handgun of the same category as the handgun the person is carrying;

Does this mean that a CHL holder can be charged with 46.02 UCW for failing to conceal?

Last time I was in need of a lawyer, the cost to go to court started at $20K... he probably spend around $50K

He got off cheap for CHL violations, assaulting a woman, multiple counts of deadly conduct, terrorist threats and possibly aggravated assault.

He either knows the right people in the right places, or bribed a lot of people to get out of those charges. For the love of God someone needs to take his weapon away from him PERMANENTLY!

I venture to guess what would have happened had another CHL'er across the room-out of ear shot-witnessed this guy pull a gun and start waving it around, what would have happened.

This guy needs to be reigned in before something more serious happens next time. I don't know who he is but his comments about being elected by the public concern me. I hope whoever supported him before realize what type of man he is and abandon him.
