Purchasing a firearm

I am working to get my Utah CWP as I am not eligible for my Texas CHL for 9 years. I emailed an instructor about a week ago explaining my situation and he tells me that I am not able to even purchase a gun directly. I guess he means i can't get a new gun or something. I am allowed to have a gun at home for protection but not allowed to have a concealed carry permit at all.

I read the Texas and Florida laws and according to you all, thanks for helping me, that I would not qualify for another 9 years in texas and 2 years in Florida.

I called the investigators in Utah and explained my situation to them and they told me that as long as I have my gun rights back that I can get the Utah permit.

Now I am confused and don't know what to do. Do I have all my rights back.

You don't say why you're not eligible for a Texas CHL so I have no comments on that part.

If you had your rights restored through a pardon or other means I think you would know. This might answer some questions. http://www.atf.gov/firearms/faq/faq2.htm#a7

You haven't given us much to go on, but it looks like maybe you are saying you got a deferred adjudication for a non-violent felony about a year ago. That would make you ineligible in Texas for another 9 years. But Utah does not consider deferred adjudication to be a conviction. If the Utah investigators told you that you were eligible, then I would trust them. They are the ones who will be reviewing your application.

With a little more info, we might be able to clarify this for you.

Here is what the Docket sheet reads for my offense:

Defendant wavied arraignment. Waiver of jury signed by all parties in open court. Defendant, after being warned, entered a plea of guilty to Theft of Property $1500-$20000 before the court. After hearing the evidence, the court found that the evidence substantiates the defendant's guilt. However, assessment of punishment is deferred. Defendant placed on community supervision for 3 years under terms and conditions that during the term of community supervision the defendant shall: (1) to (17) inclusive. regular terms. Conditions of community supervision served on defendant in open court. Plea bargaining agreement followed. Defendant advised of appeal rights. $300 fine.

6/9/08- Unadjudicated community supervision expired.

This is a word for word off of my docket sheet that i received from my lawyer that downloaded it from the Court database.

Not Proud of it, but it is what it is. And this is the only thing on my record now and forever.

Doesnt one of the rule of Supervision state no firearms?

6/9/08- Unadjudicated community supervision expired.

Did you successfully complete the probation? Pay all costs, probation fees, fines? Report? Generally keep your probation officer happy? It would seem you did. If this happened in Texas, you plead guilty, but the Judge did not find you guilty, thus if you completed your probation term, you have no final conviction for felony theft. Now, the arrest itself is like luggage, it will always be on your record. I have however read that even deferred cases with no final conviction have created big problems... When i get the regs in front of me I will try to reply again. Bottom line, if you completed probation successfully, you have no conviction on your record.
