Re: Special Status CHLs
What gets me about all of this is that he (prosecutor) FORGOT he had a firearm in his carry on bag...
But he never, until y'all got him to police station, did he identify himself as an "exempt" status...At least that is what I understood what happened...Which tells me that a person like this has no respect for the "exemption" they are given if they conduct themselves in this manner...
Is it just me, or have I just not understood why some people do not know where ALL their guns are???
Or, better yet, at least know where there are NOT any guns??? Especially in bags you are using to travel with by commercial air???
Seems to me for the longest time I checked every nook and cranny in a bag I was using for this purpose before I packed it...Pardon the pun...
Which brings me to my overly simplified solution...
Remove the exempt status...Everyone is the same...No exceptions...
Either that, or make the declaration process to carry onboard, on your person, in your carry on, or in your checked baggage options available to anyone who is not legally prohibited from owning, carrying a firearm open to every single person who chooses to do so...Period...
Enough of this dancing around...With all due respect, I'm kinda getting tired of being scrutinized and discriminated against because I am not in law enforcement...
At least I know, and will never forget where my firearms are...

Interesting that the DPD legal department says they never heard of the law, I can recall a couple of instances where I was involved in just such situations while I was a TSA screener at Love Field, and they were resolved in pretty much the same manner.
Steve - people forget guns in their bags all of the time, which is why I am a staunch advocate of concealed carry being on the body, you are a lot less likely to forget you're wearing your gun than that it is in your briefcase, gym bag, or golf bag.
CHL/LEO - does Love Field still have those bogus 30.05 signs posted?

Re: Special Status CHLs
I totally understand and empathise with those that do...Which is why I cannot recall anyone who has done so over the years this has been a topic of discussion that someone who "forgets", is not given consideration to go back and declare the firearm and put it into their checked baggage...Since no one we have heard of had any intent to commit a crime with a gun they left in a bag that got screened, just like this guy, yet unless you have an exempt status, you and I would be raked over the coals for our oversight...But that is certainly no excuse for breaking the law...jimlongley wrote:Steve - people forget guns in their bags all of the time, which is why I am a staunch advocate of concealed carry being on the body, you are a lot less likely to forget you're wearing your gun than that it is in your briefcase, gym bag, or golf bag.
So if you are of an exempt status, and forget about what you have in the bag...You get a pass...
If you or I do the exact same thing (minus the exempt status)...We get railed...
I just find the whole situation strange that if I had an exempt status, the issue would have been squared away on the spot by whipping out the ole badge (credentials) and I'd be on my way...Right??? Instead, it took a removal from the line, taken out of the airport complex to the police station, and thru that investigation (at that moment) he claims to be of that exempt status, explaining,"Oh! I forgot", and thus given leave to continue on with his day...
I say you either know fully what your status is and the parameters you may operate under, or the excuse that you forgot, regardless of your status, renders you incompetent, or just plain dumb...
Apologies for my attitude, but something about this just rubs me a little wrong this morning...

There was a time when we held certain people to higher standard because because of the trusted positions they were allowed to hold.Lawmakers, Prosecutors LEO's and Judges were among them. Today we fire teachers because they enjoy a totally legally and morally proper activitity, our law makers are given a pass on not paying taxes, and we dismiss, DA and judges for something these same judges and DAs would throw the book at a common peasants who did the same thing. It ain't right. I don't understand.

You will still see them in a few places. It's fixing to be a moot point (the legality and enforcement of them already is) because they are building a new terminal and that should just about eliminate anywhere the existing signs are posted as they demo the old one. There may still be some up at the parking garages - I'll have to look and see if I can notice any. Hopefully they will not try to put these type signs back up when they do complete the new terminal.CHL/LEO - does Love Field still have those bogus 30.05 signs posted?
However, there are still plenty of them up on various City of Dallas buildings around town but I don't think there is any legal way to force the city to remove them. Most everyone on here knows that they are unenforceable but a new CHL holder might not be aware of that.

When I first started reading it I thought he was gonna flash a CHL badge
It is said that if you line up all the cars in the world end-to-end, someone would be stupid enough to try to pass them

What I think happened is that they made all these secure areas like courtrooms. Then they tried to say a judge or attorney could carry in his work area, like most people can. But in writing the exception, they made it overly broad and this case is the example of someone taking example of it. This is what happens as they try to ban everything and then let some people do it for their special interests.CHL/LEO wrote:Until the responses on this thread I've never really paid that much attention to 46.15 as it's really one of those non-event chapters that you don't ever run across much. I still would love to know what the legislature was thinking when they created all of these exceptions and entitlements. I can somewhat understand about letting a judge or prosecutor carry concealed in their courthouse, but why an airport? The same with off-duty CCP 2.12s - why should they need to carry into a secure area of an airport? There must be something I'm not seeing on this, but with our legislators - maybe not.![]()

While I can buy that, I'd rather they just had a separate "Courtroom CHL" or the like.srothstein wrote:What I think happened is that they made all these secure areas like courtrooms. Still, if I'm not a good enough citizen to carry in a courtroom or airport for self protection, neither is a Judge or Prosecutor. Nothing about those titles makes them any less likely to "snap" than I would be.

Re: Special Status CHLs
Call me cynical, but I have a somewhat more jaundiced view about why judges and prosecutors got exemptions to everything. Count the number of lawyers in the legislature. What positions in the law field have they held, or want to hold, or will hold in the future? Who are their friends and colleagues? Which lawyers are the most politically powerful? Easy to make exemptions for those you know...CHL/LEO wrote: I still would love to know what the legislature was thinking when they created all of these exceptions and entitlements. BINGO. Still waiting on that bill to appear this session...CHL/LEO wrote: I guess the thing that would make the most sense would be to let CHL holders carry in the same places that any of these exempt folks can carry and then it would be fair for all.

Much more important than open carry or employer parking lots imo.ELB wrote:BINGO. Not for me. I can live with most of the restricted locations as I very infrequently visit one, but I come to work every weekday!Captain Matt wrote:Much more important than open carry or employer parking lots imo.ELB wrote:BINGO. I go to work 5 days a week and I agree with Matt. Keeping a handgun concealed or finding a different parking lot sounds a lot easier and cheaper than being arrested and prosecuted for carrying in arbitrary off limits places where off duty cops are allowed to carry.
I say that as someone who knows. This is what policy lets me carry at work.
