Background Check question

back in 99 I was charged and arrested on a felony.

It was found out that I wasnt "the guy"

Case was dissmissed.


Would I have a problem?

Ive been able to buy guns from gun stores and passed THAT check...

To avoid delays, you should get paperwork from the court stating that the charges were dismissed and include it with your application.

OK, just got off the phone with the attorney. He said on the app, DO NOT SAY that I was arrested since it was expunged. He said legally, nothing ever happened.

so for future reference... if you've had something expunged DO NOT SAY YOU WERE ARRESTED.


If hes wrong, and my app is denied, I'm going to have harsh words with him.... :thumbs2:

Why not just put that on your application?

The court in the jurisdiction should be able to provide you documentation to that fact, or a document stating that they have no record of your arrest. It's better to list it on your application, and provide that documentation, because the DPS will find it, and it will cause delays if the arrest isn't listed.

That's the gamble. If you don't list it and DPS doesn't find anything in their seartch then you're fine because it was expunged. But if you don't list it and DPS finds any record of your arrest then they can reject you because of false statements on your application.
