Wall Flower or Casual Observer

Post by sig229fan »

Perhaps just me, but each time I visit a new store, I stand out front looking for the dreaded "do not enter" or "30.-06" sign. I often wonder how many CHL holders can remember what the brick, windows, doors, or landscape look like of the shops we frequent for the first time..... :coolgleamA:

I look, but don't search for the sign.

It's supposed to be conspicuously posted adjacent to all entrance/s with contrasting 1" high letters in two languages. Right?

It should be, but in the past few months I have found numerous places that make it difficult. For example the Fort Worth Zoo, look for signs, stand in line, go inside park, and then see 30.06 sign....get hand stamped, walk back to car, hope I am not the unlucky theft victim, and then try and catch up with the family.

Isn't the Fort Worth Zoo owned by The City of Forth Worth? IE, rendering the 30.06 sign not valid?
Apparently not. Too bad, the FWZ was always one of my favorite zoos.

From their website:
In October 1991— with the Zoo facing decreasing city support, demands to replace outdated animal housing and declines in attendance— the Association* assumed management of the Zoo's day-to-day operations under a contract with the City of Fort Worth. (*Fort Worth Zoological Association)

Yes, they assumed management of it, not they bought it. The Houston Zoo tries the same misleading wording on their website, as well. The truth of the matter is that the property is still owned by the City of Ft. Worth (or Houston, depending on which zoo you're interested in), so any 30.06 sign is unenforceable.

Also, Oldgringo and 03Lightningrocks, PC30.06 requires a sign to be conspicuously displayed, but does not require it to be displayed at any entrance, much less every entrance. Here is the text:
(3) "Written communication" means:
(B) a sign posted on the property that:
(i) includes the language described by Paragraph (A) in both
English and Spanish;
(ii) appears in contrasting colors with block letters at least
one inch in height; and
(iii) is displayed in a conspicuous manner clearly visible to
the public.
Remember, in a life-or-death situation, when seconds count, the police are only minutes away.

Thanks for the clarification.

IANAL, but I figure the definition of conspicuous would have to mean that it's clearly and easily visible where one would look prior to entry onto/into the forbidden premises. Otherwise, its concealed and/or obscure visibility could be considered entrapment?

Like I said, IANAL. Good luck y'all.

I'm not a lawyer either, but if they have a 10' by 10' sign over the counter at Taco Cabana (this is hypothetical, folks :biggrinjester: ), I think they've given notice, and I would be legally obliged to turn around and leave the premises to either disarm and return or not return. Just like if you entered a facility and were then verbally told, "No firearms are allowed in this building." by the building owner. You're already inside, but you've now received verbal notice per 30.06, so you must leave and either not return or disarm before you do.
Remember, in a life-or-death situation, when seconds count, the police are only minutes away.

I do the same, and snicker to myself when I see "gun-buster" signs.

What I really like are the signs that (I paraphrase here) state that the "unlawful possession of firearms is forbidden". Those tell me that they respect the CHL-holder and recognize the good folks from the bad folks.
