Houston police said Allison Sarah Aubrecht, 17, was one of about eight people at a party at a home in the 6500 block of Westview Drive on Sunday.

Robert Odom Jr., 20, pointed a newly purchased pistol at the back of Aubrecht's head, believing it was unloaded and pulled the trigger, officials said.

Aubrecht died at the scene.

Odom was charged with manslaughter.

"He barely got the gun -- maybe Friday for protection. I was over here maybe 30 minutes prior to it happening, and he called me over to come look it and I looked at it. It wasn't loaded. I didn't see no bullets or nothing," neighbor Robert Peach said.

"For what I knew him, he seemed like an alright person," a friend said. "I know he's really heartbroken about this cause he realized he made a major mistake. It was a complete accident and I'm sure it's going to haunt him the rest of his life."

The party was held at the house Odom was renting from his father.

"She has been at the location before," Sgt. R.D. Chandler said. "She was staying there now just as a friend."

There were no arguments or physical fights before the shooting, investigators said.

"Right now, we believe that it was just a tragic accident," Chandler said.

Aubrecht was a student at Memorial High School.

Detectives said evidence of drugs and alcohol were present at the party.

Odom has three prior convictions -- two for theft and one for driving with a suspended license.

Odom is expected to make his first court appearance on the manslaughter charge on Tuesday
This guy needs to go to jail for a very long time!!
Obviously this guy has never heard of the 4 rules, this is the type of thing that gives the antis more fuel for their fire.

If he is only 20, how did he purchase a handgun?

That's the first thing I noticed, too, just before the sentence which included 3 violations of the 4 Rules. Amazing. You know, the one gun control purchase law I would be in favor of is an IQ test. Or at least some brief, mandatory education about the 4 Rules.

Wouldn't these convictions also prohibit him from handgun purchase? Or do they only prohibit CHL?

It depends if the thefts were felonies or misdemeanors.

Yes, he broke all the rules of gun safety, however he committed the cardinal sin of gun possession....

I don't see how he was able to buy the gun in the first place, unless, he bought it off the street from another crook. All this does not matter to the antis...they love this kind of stuff so they can torment the rest of us.

This is terrible reporting!

So all the ignorant now think its ok to buy a gun with such a record. Amazing.

I am the last one for more regulation but something has to be done to keep guns out of the hands of the mentally challenged. Apparently, he did not buy the gun legally since he was only 20 years old but this is happening way too much, things like this will give the anti-gunners more ammunition in the fight against our gun rights. I think I would vote for a mandatory safety class for 1st time buyers, something has to be done.

Apparently he hadn't heard about the drug and alcohol laws either. This may also have affected his grasp of the 4 rules at the time of the incident.

The statements from some of the other partygoers also suggest that this party was not a gathering of doctors, lawyers, and architects with CHL's.

The antis will use anything, or nothing, to attempt to impose their agendas on the rest of us.

Misuse of inanimate objects by the criminal, the stupid, and the negligent is an unchanging constant throughout history, not an exception to get hysterical over. When folks drag out the "if he hadn't had a gun, this wouldn't have happened" consider telling them you're starting a movement to end carjackings, and drunk driving accidents by advocating laws that would take away their ability to own cars, and ask if they'd like to contribute to your campaign.
