Employer "premises"

Post by JackRR »

My employer bans "deadly weapons/firearms" on its premises according to its handbook. I assume this includes the parking lot.
But does it?
1. Checking the county tax records, someone else actually owns the land/property.
2. No 30.06 signs or any non-gun signs for that matter on property or outside entrances to store. My company does nothing at all to discourage legal carry with its customers. Only employees for liability issues I assume.
3. Nothing in the handbook mentions parking lots.

I realize I can be fired if I carry inside my store (even with CHL license), but stored securely in my car, is that fair game?

I wont ask the HR person or management to avoid any verbal warning.

Isnt there some legislation pending on this issue?

Yes there is legislation pending. SB 730 addresses this very issue. Until passed even though the parking lot is owned by someone else if your employer is leasing the lot or a portion of the lot, then the employer has care, custody and control of the lot or portion of the lot. Which means they can regulate it.

SB 730 would prohibit an employer from prohibiting a person who is a license holder from carrying in their vehicle and parking the vehicle in the lot. The employer would have the right to dicate the weapon be in a locked container within the locked vehicle and concealed if they so desired. The law is specific to privately owned vehicles. The employer would retain the right to prohibit weapons in company owned or leased vehicles.
