NICS Delay question

I just tried to purchase a rifle at Academy on Wed and I am still waiting on my CHL so I had to do the NICS check. It was put on delay.
Academy said they would call me as soon as they heard back.

I read on the FBI website that if a request is put on delay, the store only has to wait till the end of the 3rd business day to hear a response. If no response is given, they can then sell the firearm at their discretion. Am I accurate in my interpretation of this? If so, and I get to that 3rd business day (Im on day 2 now), how do you recommend I approach the store?

Also, would you recommend that I call Academy and ask if they have heard anything today (the 2nd day)? I know they are a chain store and the employees aren't always as on top of things as one would like. Do you think that would be more of a bother to them or would it be worth the call?? Thanks!

You have the correct understanding of the rule.

Certainly you can contact them to see if they have an update, they are able to check it online. Before the end of the third day, if it should be denied, they will get a voice confirmation from the NICS folks to insure they are aware of the change in status. If this occurs, you may file an appeal, your dealer should have the info for that.

Otherwise, I'd be there on day four to pick it up.

If you run into this often, you should look into a UPIN.

Or a CHL right? Once you get your CHL there is no need for the NICS check right? Paperwork ahs been sent it but we all know how long that takes. Thanks for the info on them being able to check online. I might just give them a call today since its Friday. If not, I will be there on day 4 (Tuesday)

One more question...
Does anyone have any experience on being delayed past 3 days? Do chain stores like Academy usually have policies regarding this? Or do they really leave that decision up to the employee/manager on that day? Thanks!

I was unaware that they do NICS checks for rifles.

i do know that if you dont provide your SSN # ,which is optional , it can take longer.

mine have only ever taken 5 to 10 minutes .
i wish DPS could be that quick. :shock: i'll even settle for 3 days :roll:

Re: your question regarding CHL and calls to NICS. I have found that many of the big chain stores still require their counter sales people to do the NICS call. I know Academy in Dallas and BassPro still do the call as a matter of procedure.

It varies by company and maybe even store.

The handguns I have purchased through academy with my CHL have both been without a NICS call. I even had to show one gun store employee where to put the info on the 4473 regarding a seller with a CHL as I was the first one they personally had ever dealt with we then talked about CHL's until a senior employee showed to inform them they had done it correctly.
How do you explain a dog named Sauer without first telling the story of a Puppy named Sig?

Well I called and was able to pick it up today. They said they called me, re-read me the number they called but I never got the call. They must have dialed it wrong.
Either way, hopefully the CHL will help solve some of these issues.
And I agree with usa1 - If DPS would only be that quick! It would be nice if they ran it like the NICS...if you dont get a response in 3 days you automatically get the license.

The Academy in Plano was like...woohoo...we don't have to do the nics check when I handed them my CHL. If there is a store that wants to further restrict my right to keep and bear arms beyond what the government requires, I will never shop there again...for anything.

I suspect there is a moron working at the academy that did this...probably an anti-gun moron at that.


As to the OP's issue with the delay. this use to happen to me all the time. I could not figure out what the problem was. One day I was buying a rifle at a shop and a very wise female employee noticed I was leaving Jr. off my form. Boom...it passed. Apparently it takes but one little item not filled out perfect and it get's delayed for a supervisor to look at. After three days with no denial, you are approved by default.

When I presented the CHL to the folks at Acadamy, they said, "Great! This is doing it the easy way" If its easier maybe they could give us CHLers a little discount?
