Fiesta posting illegal and incorrect sign

Post by YabuUS »

The Fiesta at Fondren&West Belfort has a sign posted claiming it is illegal to carry a gun on the premisses where alcohol is sold or consumed - period! The sign claims that this is a felony, but cites no law to back it up. First of all, the sign is not a legal sign. Second, Fiesta is not a 51% establishment. Third, the is no law that says you can't carry a gun with a license in a supermarket. The sign in question makes no mention of a license at all. This is pure bull! :rules:

The sign is legit as required by TABC, but does not apply to CHL holders. It's the "blue" sign. It's at very corner store, grocery store, walmart posts it at the top of the beer cooler.....etc.

The only signs we ever have to pay attention in regards to alcohol is 51% signs when the establishment really is 51%, which can be confirmed by having a look at their license.

Is it one of those old "FELONY NOTICE" signs?

I've seen one of those behind a bar at a restaurant that also posted the correct signage (the blue unliscenced felony notice) at the door.

I think they are old signs.

How do you search the TABC website?

There's no Walmart in this center. The sign is not Blue, it's posted up over the front door to the market. It is a paragraph and is part of a larger sign which talks about the store hours of operation along with no smoking and not selling tobacco to minors. It doesn't meet any description of a legal sign I'm familiar with. It also gives no reference to any law it claims to be talking about. I know a CHL holder could ignore this sign - that's not my point. I just don't think Fiesta should be making up laws and then posting signs to that effect at their doors.

Just curious - is there any penalty for a store posting bogus warning signs? I guess there is no law against it, but it sure is "dirty tricks". :???:

Sorry about the double posting. I don't know how that happened. I clicked once and it posted twice. I didn't mean to do it twice. I guess enough has been said about this. Just to offer one parting clarification, the sign I am talking about doesn't mention licensed or unlicensed period. Those words are not on the sign at all. It simple says that carrying a weapon where alcohol is sold is a felony. I don't think that is true and that was my whole point. Thanks.

I think it would be a poor idea to wish for a law that establishes a penalty for improper signs. I'd much rather walk past unenforceable signs -- especially "30.06 attempts" -- instead of having the signs taken down and replaced with the real deal.
Carrying since 02/06/2009.

It is illegal to carry into an establishment that sells alcohol for off-site consumption... :rules:

Perhaps it's an old sign from 1995 or earlier.

If it's not a proper 30.06 Sign, or 51% sign, and not a place prohibited in the statutes, I will ignore it, plain and simple.

I have to admit I had forgotten how long ago the carry law was passed. Yes, it was in 1995 and if this sign is older than that then I suppose it is correct. Still, as has been pointed by a couple of posts, it is a non-issue for CHL holders. Much to do about nothing I guess. Thanks for the input.
