ATF warns all gun dealersover mcnair shooting

"Though the gun sale in question did not involve a licensed gun dealer, the ATF recently warned all gun dealers in Tennessee that they must still comply with federal gun laws despite a new state law aimed at easing such requirements for weapons manufactured and sold in-state."
May be the start of some new challenges. :totap:

p.s.- I haven't done any research yet, but is tennessee one of the states that passed the 10th amendment that says the government can no longer regulate the sale or possesion of firearms made in that state?

I thought only Minnesota actually passed such a law at this point.

I think that was Montana, unless Minn did also.

"I would have liked to have seen Montana..."

Yes, I'm pretty sure it was Montana that passed that.

It probably was Montana. Anyway, I think they are the only state that has passed something like this. Other states have talked about it, don't think they've actually done something legislatively yet.

Why are they warning dealers? Didn't the killer get the weapon from a convicted felon? We know the convicted felon didn't buy the gun from a dealer because he would have been stopped by the "are you a convicted felon" question on the yellow form.

I thought after the yellow form was filled out the information was checked by an FBI check? Any lie would be caught there wouldn't it? :???:

Gilliam — who was convicted in 1993 in Florida for murder and attempted armed robbery —
What the heck is this guy doing out walking around amongst us law-abiding citizens in the first place? Murder + attempted armed robbery? Sounds like a capital crime to me. Should be a minimum life imprisonment, if not the death penalty.
"No one denies this is a tragedy," he said. "Steve McNair was one of Nashville's heroes. A lot of lives have already been ruined. But Mr. Gilliam is a decent, hardworking family man and there's no reason to ruin his life too."
I'd say a capital murder followed by accomplice to a second murder years later qualifies as a "reason" to "ruin his life".

Ok, a pawn shop I can see...

But a private individual downstream of this is a bit intrusive, but that is just my opinion...

But the ATF sure did lower the boom by "warning" every other dealer about all of this...

Way to go guys... :thumbs2: /sarcasm

Governor Phil Bredesen will not stand in the way of House Bill 1796. He will allow it to pass without his signature.
I don't know the vagaries of TN law to know how exactly the process of passing without signature works there, but it appears to have had enough support in the legislature to override a veto if that had been an issue.

From the article:
The Tennessee General Assembly lacks the Constitutional authority to limit the power and authority of federal government in this way…
I would say the Federal Government doesn't have the Constitutional authority to limit the power of the Tennessee General Assembly within the State of Tennessee, per the 10th Amendment.

I believe that the Feds will wait and smack down the first real sale on this law and deal with it by revoking the FFL or the seller.
Then who will defend the seller? The State? The NRA?
I'd wait until Montana's law came online and then do a sale in both states at the same time and let the Govs of each state do the purchase. :rules:

THAT will get the Feds attention! :fire

Is it me or why is it that the quote "anti gun" folks out there seem to be targeting US as we have to pass a screening process to buy and or carry, as due LEO's I'm missing the point here... :headscratch

That like saying the 1st 2 letters of A T F, have no responsibilty concerning what they represent... :confused5

If the Tennessee governor doesn't have the cojones to sign the bill, he probably would not make the buy either.
