Background check info

Post by texxas guy »

After waiting a 130 days, I called DPS on Friday, and was told by the person there that "something came up" on the background check. I said I listed my only misdemeanor arrest and dispostion on the application, and she said she would transfer me to the person working my file. Upon transfer, got the infamous voice mail. Left a msg. No response as yet.
My DWI (first, last, and only offense) was back in 1990. All of my personal records regarding the case, were destroyed in a fire in 2000. I spoke with my CHL instructor and he told me to list the info I had on the application and go ahead and send it in. I did this, giving date of arrest, what charge, disposition, and a brief note explaining that my records had been destroyed in a fire.
This should not keep me from getting my CHL. My question, how does DPS verify the dispostion of the case, which was probation and fine? Is there anything I can do to help speed this along?
Thanks in advance for your help. This is a great site with lots of info. :txflag:

If you want to speed up the process (and trust me, you do), then you need to send DPS a copy of the disposition of your case. If you don't have that, then you need to get a copy from the county criminal court clerk in the county where your case was heard.

Crossfire, thanks for the info. Looks like I got some bad advice from my instructor. So, even though I have received no request for info or explanation from DPS, I should go ahead and send them the dispostion?

I'd at least get it, if for nothing else then your own records. You'll need it at each subsequent renewal, might as well get it now.

I'd also suggest getting a certified copy of the disposition. I learned the hard way that the disposition is called(in LEO circles) "Final Sentence and Judgment". I lost almost 2 weeks for not knowing the exact, precise terminology before I got what I wanted, and mailed my packet to DPS. Hope that helps a little bit.

If indeed, the records were lost in a fire, then I suggest getting a certified letter from the LEO agency that there are "no records found", or something similar in wording.

And Crossfire, thank you for all of your help when i was asking questions. :txflag:
