How to obtain an FFL in Houston?

Post by tateb24 »

I have been looking online for the past week trying to find laws on FFLs in Houston. My question is can I have an FFL in Houston, I live on the West side of Houston, inside the belt way. Are there any ordnances, laws, statures that prevent me from obtaining one. I couldn't find any laws on the Houston City website. Please answer if you are really familiar with the laws in Houston. Thanks

I'd suggest going and visiting with the Business Development folks at the Houston Chamber of Commerce and discuss your desires with them. They are probably intimately familiar with licenses, ordinances and permits about opening up a business in Houston.

While the chamber of commerce can help you (and is a good recommendation), there is also another group that should be able to help you also. Houston has a city one-stop Permit office, here is their web site: http://www.houstontx.gov/onestop/index.html" onclick="window.open(this.href);return false;

On the FFL restriction, about the only thing to really watch for is zoning violations. If the city restricts you, it is going to be by zoning. They cannot regulate a federal license otherwise. I think, but I am not positive, that the ATF will check to make sure your location is properly zoned for commercial use before issuing the license.

It's Houston: no zoning.

That means it's down to restricted deeds & covenants, HOA rules, and business licensing.

What kind of FFL? Only Types 01 & 02 are likely to run into any restrictions, because they're both retail customer-based businesses.

If it is not prohibited in your deed restrictions and you are not within 1000' of a school then you should be ok.

Having said that the ATF will drag their feet. Just remind them it is a shall issue license.

You can get a kit or FFL checklist for $25.

PM if you need more.

Nothing requires an FFL to be 1000' or more from a school.

What's the benefit of getting an FFL?

Following the law if you're in the business.
