CHL Holder arrested at Denton Mental Health Facility

Not sure if the facility was posted properly or not, but I'm thinking that with the threats of "shooting his way out of the place" (if he said that, the story reports that his wife said he said it) and failing to surrender his weapon to the police he's in a heap of trouble even if it wasn't posted.

Black eye for the rest of us law abiding citizens who carry responsibly.

He was charged as a concealed carry license holder with carrying a weapon into a prohibited place.
This is either the wrong charge, or it's being reported wrong.

A hospital, even a mental health facility, is not a prohibited place. Maybe it was posted 30.06 and they charged him with trespass. But can it really be trespass if the person is there involuntarily and trying to leave?

Technicalities aside, it sounds like he really doesn't need to be carrying.

Wouldn't it be nice if Denton PD put that .40 Sig up for sale so
some non-mentally disturbed CHL could buy it?

Denton's just up the road from me. If the price was right, I'd be

Not sure if Denton Regional has a Mental Helth clinic, but if so, the hospital is properly posted.

:iagree: If it was legally 30.06 posted I would think that trespassing would have been the charge and / or brandishing / failure to conceal.

Sounds like there's a history here - sounds odd she would take him to a mental health clinic if it was a one time case of yelling and kicking the dog.

We are most definitely not getting the whole story. What we are getting is probably not even close to the truth. Something smells bad.

Could it have been the Denton State School? I've often wondered about this. It's not a school in the normal sense of the word, but does it still qualify? If so, there would not need to be any 30.06 sign at all.

Okay. He was probably not at the Denton State School. Interesting point here, though, it appears he was in a room. It could have been in the ER, but the individual rooms there don't have bathrooms. If it were a regular room after being admitted it would be interesting to note that he made it through an exam in the ER without anyone finding the gun. This doesn't seem very likely. He was likely in a bathroom near or in the ER.

I'm still interested in someone that knows or anyone's take on the State School situation.

Denton Region is correctly posted 30.06, much to my protests to the person who could remove the signs.

He has his CHL, but not the "personal" equipment to remove the correctly posted 30.06 notices. :roll:

Sounds to me like the guy is mentally disturbed. Look for the charges to be dropped with the provision that he gives up his chl and agrees to be treated by a Shrink. After all it is not pc to punish crazies.

Sec. 46.035. UNLAWFUL CARRYING OF HANDGUN BY LICENSE HOLDER.

(b) A license holder commits an offense if the license holder intentionally, knowingly, or recklessly carries a handgun under the authority of Subchapter H, Chapter 411, Government Code, regardless of whether the handgun is concealed, on or about the license holder's person:

(4) on the premises of a hospital licensed under Chapter 241, Health and Safety Code, or on the premises of a nursing home licensed under Chapter 242, Health and Safety Code, unless the license holder has written authorization of the hospital or nursing home administration, as appropriate;
