CHL requirements

If I have a Utah CHL (which is recognized by Texas) , but live in Texas permanently, will the CHL still be recognized in Texas?

First off, welcome to the forum! :tiphat:

If it is considered a non-resident CHL from Utah, then you should be OK. Just make sure the address on your CHL is correct showing your Texas residence.

A couple of caveats on carrying on a non-resident CHL:

1. You do not get the Gun Free School Zone exemption that a Texas resident carrying on a Texas CHL receives, so you cannot carry on school grounds or within 1000' of a school.

2. Some LEO's may not know the reciprocity rules on a non-resident CHL. BTW, in Texas you are required to show your CHL if you are asked for ID by a LEO when carrying.

What brought this up was a friend of mine has a group that is going to have a Utah instructor teach a class in Texas for Utah CHL (no shooting required just class room) for their requirements. Got me to thinking about Utah CHL with TX address and resident of TX.

Another question: Are schools built a 1000’ off the streets? I have an elementary school between my house and the neighborhood exit with out another street to get out.

The 1000’ is that just during school hours? Thanks Kingseeker

If you are on your own property within 1000' of the school, you are exempt. However, once leaving the property without a CHL from the state you are living in, then you are in violation if you are within 1000'. And there is no distinction with during school hours or out of school hours (7x24.)

This was discussed in great length in another thread.

I think the end result was, yes, thousands of people potentially violate this law daily by driving through a school zone with a handgun in their car under the MPA, driving to the range, etc etc.

There have been no 'stings' that we know of to try and catch people driving by schools with guns in their cars.

This is a Federal law, so local police generally don't enforce it unless you've already been arrested for something else. Eg, it is used as a 'tack-on' charge, for example, if you get arrested within 1000' of a school for another reason, and happen to have a gun on you, it's just another charge they add to the 'pile'.

The federal law applies to all firearms, not just handguns. So driving to the deer lease with a rifle, or going to the skeet range, can cause someone to violate the federal law if the gun is in a case and the case isn't locked.
