The answer is: Depends

If it's an assembled SBR, yes, you will need the tax stamp in advance.. Any Title II Weapons dealer will help you with the paperwork. Generally, you go in, put money down, fill out the paperwork, and they hold it until you receive your stamp.

If you're custom building it, you don't NEED anything other than the parts to physically build a SBR.**
You can obtain a stripped or complete lower from almost anywhere, and the rest of the parts can be ordered online. You could completely just build a SBR in your home.**

What you're supposed to do, is obtain the Tax stamp before even Owning all the parts to build it. Once you receive the tax stamp, THEN you go and order the rest of the parts to build your SBR. Owning the parts before having the tax stamp could be construed as attempting to illegally construct.

tl;dr version: Get the stamp first, then pick up, or build your SBR.

Also.. Go the Trust Route. No LEO Sign-off Required, and it allows multiple people to have possession of it.

A tec-22 has all of that except #4. So does a GSG-5, MP5, etc.

if you are going to built it yourself,you have to wait till your form 1 in hand before you can have a complete SBR.You can not bulit it first then apply for SBR,and you can file form 1 application yourself without going through title II dealer.
You only need to pay that $200 tax stamp one time,doesn't need to renew it every year.

So if I have a pistol upper or even a short barrel then i am in violation? Parts are parts, how could they convict (or even know) on that? Washers and pipe make a silencer so are we all in hot water since every garage has those? I would like a bullpup SBR, PS90 or CX4 Storm but too much hassle.

It's called 'constructive intent'. Just having the parts on hand to make an unregistered SBR can get you in hot water.

Every time I've built a pistol, I make sure to have a dedicated lower on hand before I purchase the pistol upper (preferably one marked as pistol). And I never use a buffer tube that can accept a stock.
