Can someone who lives out of state purchase a firearm at lets say Academy or some where of the like?

A resident of any state can legally purchase a long gun (rifle or shotgun) in Texas, if
  • the buyer is legally allowed to purchase the weapon under federal law and the law of the state where he resides
  • the seller is willing to sell
A store like Academy may well have a policy against selling to an out-of-state resident, because they do not want to figure out the laws of the other states and individual cities (some cities have "assault weapon bans" and other nonsense).

Probably a regular gun store would make the sale.

Pistol? No.

Rifle or shotgun. Maybe. It depends on the state the store is in and the purchaser's state of residence.

What if they are Ex-LEO, would somewhere like GT sell to them?

Former or current law enforcement officers have no special privileges when it comes to purchasing firearms.

Rules aren't any different for ex-LEO, or even for current LEO buying for their own use. A current LEO buying for duty use with chief's signature might have different rules, but I don't know.

Well, I was in a gun store about 2 years ago and the store person refused to sell a revolver to a guy because he did not have a Texas DL.

Which was correct, assuming the guy was resident in another state.
