My apologies if this is the wrong topic to post this on, moderators please move if needed. My daughter is going to New York City for a week and needs to know if she can legally have her pepper spray with her in the city. She is her fathers daughter and knows her way with and around firearms and is currenty pursuing getting her chl here in Texas. Concerned about protecting herself there, she is wanting to be equipped with whatever is legal while she is there. Can she legally have her pepper spray with her in the city and how can she take it with her while traveling? Should it be packed in her luggage? Is it legal for her to have it in her purse while boarding the plane? Thanks for any advise with this adventure.

GENERALLY - NY Penal Law applies an exception to the various "Criminal Possession of a Weapon" sections as follows:
14. Possession in accordance with the provisions of this paragraph of
a self-defense spray device as defined herein for the protection of a
person or property and use of such self-defense spray device under
circumstances which would justify the use of physical force pursuant to
article thirty-five of this chapter.
(a) As used in this section "self-defense spray device" shall mean a
pocket sized spray device which contains and releases a chemical or
organic substance which is intended to produce temporary physical
discomfort or disability through being vaporized or otherwise dispensed
in the air or any like device containing tear gas, pepper or similar
disabling agent.
BUT NYCity may very well have extra laws.
The search feature on the NY Penal Code site is not working, so I was stuck with a manual look where I know the weapons statutes are.

Thanks Russell, That's what she is going to do. She also has a personal alarm that she carries in her purse, pull the pin and all I can say is plug your ears because the sound it puts out will curl up a gorilla gnawing the bark off a tree.
