MPA repealed

Post by Cobra Medic »

Did the Motorist Protection Act get repealed?

Recently I see a lot of comments like the one quoted below where people predict trouble, including getting arrested, if you have a gun in your car and don't have a Texas handgun license.

So did MPA got repealed or is it still legal to have a concealed handgun in your car in Texas without a Texas handgun license?
This will only hurt a little. What comes next, more so.

Good to know. I wonder what's up with people prediciting arrests and other unpleasant consequences during traffic stops if a Texan has a CHL from another state or (worse?) a Texan has a concealed handgun in their car with no CHL at all. It's not the first time I see it here. :headscratch

I have seen the same things, but I think what you are seeing is the "what if's" situation, and "depending on how much the cop really knows about CHL or MPA laws"

As some on here can testify to personally, when following the law, they still ended up being test cases, due to LEO's not knowing the law the way they should have, before arresting.

I believe the quote above and most like it I've seen are referring to carrying under MPA when you have a CHL and it's suspended or otherwise invalid for some reason. Some people think you could then still carry in the car under MPA while others think that your CHL status trumps the ability to carry in the car under MPA. And whether it does or not you're likely to get hassled by a LEO if stopped.

More of a reason to get familiar with the states legis website and read/reread the laws for yourself. Mall ninjas and gun forum posters are often way off in the advice they freely give (not a knock on anyone specific...more of our 2A internet literate group as a whole).

I'm a Texas resident with a Florida non-resident "CWL" and I've never had a hard time with any agencies in Houston, even after numerous encounters.
