Selling a gun in TX
I have guns that I bought at stores or gunshows in texas that I think I am going to trade or sell for others. What are the rules about doing this? I bought a gun from a forum member here and I payed them and go home with a new toy. Are we suppose to go through an FFL?
When I bought my last gun at the show I filled out that form and they called someone and made sure I was ok. I passed and I took my new gun home. Does that form and call just check to make sure I am not a bad guy or do they actually tie the sn of the gun to me?

I think it depends... If you're just a person who collects guns and occasionally sells the ones you don't want anymore, I think it's just like selling anything else. If you're doing it to make money, though, you have to set yourself up as a gun dealer and do all kinds of paperwork-n-stuff. I think.
I am not a lawyer, nor have I played one on TV, nor did I stay at a Holiday Inn Express last night, nor should anything I say be taken as legal advice. If it is important that any information be accurate, do not use me as the only source.

That is me. I am not a dealer. I am just a guy who likes guns!Dave2 wrote:I think it depends... If you're just a person who collects guns and occasionally sells the ones you don't want anymore, I think it's just like selling anything else.

Not if both parties reside in Texas.tubular031 wrote:Are we suppose to go through an FFL?
Some people want documentation and some don't. I personally just use my best judgment..(profiling if you will).
If the buyer has Texas license plates and a Texas drivers license, and not dressed like a thug, then that's good enough for me.
My preference is to sell to fellow CHLers and have done so a couple of times to members of this forum.

As I understand it, face-to-face sales of firearms between individuals is legal in Texas as long as the seller has reason to believe that the buyer can legally own firearms. That is why many sellers posting ads on this board want to do business with someone who can produce a CHL. It removes most doubts that could arise about whether the buyer can legally own firearms.

If you have a gun you've bought, shot, and now want to move on to something else, you'll be fine.
If you start buying a gun on monday to sell it to someone else on tuesday, then you might want to reexamine what you're doing.
Basically, if its all about your own personal collection I wouldn't worry about it.
If you start doing it to make money, you might start getting visits from friendly men in suits!

Re: Selling a gun in TX
Anyone know the answer to this part? I dont recall signing the form at the gunshow that had a SN on it. just info about me.tubular031 wrote:When I bought my last gun at the show I filled out that form and they called someone and made sure I was ok. I have a few guns that I bought back when I lived in CA and I know they tie the SN to you. If I sell those, I will require the buyer to use an FFL.

You're ahead of the game..most don't do that and they find out the hard way.tubular031 wrote:Yup I know about that rule.
