pardon my attempt at humor, just sorta got an issue on my mind today makin' me
making involuntary movements "that could have been perceived as a threat."
I can't judge the guy without more info, if there's a threat, stop it, if there is no more threat, time to quit ... I wasn't there .. if he needed another gun or a howitzer to stop a continuing threat, okie dokie, if not ... well ... if the guy was gonna die before ANYWAY ... how did 5 more hurt?
the first shot was "probably by itself fatal though not necessarily immediately."
So, it was a humane gesture to end his suffering earlier ...

If I remember right, his big problem was that he talked to the police too soon and likely without an attorney. (If he had an attorney, it was the worst one ever).
His account of what went down was not in the same sequence as the video. That, plus the way this tape 'look's got him in a lot of trouble.
My guess is that, had he waited for an attorney. Got his memory in order (and sync'd with the tape), and explained properly each action, he would have been ok legally. But his saying that he shot his first gun, got his 2nd gun, then ran out the door and came in and shot the guy again was out of order, and gave the Grand Jury, and prosecutor a good reason to charge him.
