Which FFL does the background check?

The one receiving the gun or the one sending it? I have CHL and know it's not required but what about out of state purchases? Thanks....

I'll try to use some logic here, but it's not based on hard knowledge.

It seems it would have to be the "sending" FFL since that's where the firearm
is starting its journey to you, the buyer.

I think its the one that actually gives you possesion of the firearm. Ive only had one person order me a firearm and he didnt ask for any info till i actually picked the firearm up

Let's take this one step at a time.
  1. You buy a firearm from a seller in another state.
  2. The seller sends the firearm to an FFL near you.
  3. You go to that FFL near you. He either performs a NICS check or sees that you have a valid CHL and do not require a NICS check.
  4. You take possession of your new purchase.
  5. :fire
A NICS check must be done by an FFL in the physical presence of the buyer.

None! I have a CHL. :thumbs2:

I agree with Jim. The FFL who transfers the gun to the unicensed person does the NICS check. Everything before the final transfer to you, from the manufacturer to the distributor to the dealer, and sales between dealers, is a transfer between licensed firearm dealers and no NICS check is done for FFL to FFL transfers.

the FFL who will let you physically take possession of the firearm is the one who has to process the 4473 and do the NICS check (or record your CHL info).

I didn't have my CHL on me the last time I bought my gun - but I did show him my trusty CHL Badge and Sash that I was wearing... no questions asked! :biggrinjester:
