Denton Arishow - CHL - What do you think?

Post by Zoti »

The FAQ states NO FIREARMS. http://denton.schultzairshows.com/denton-FAQ.html

Anyone been in last years? Do you get searched?

I've been to the alliance airshow but that was before I had a CHL. I don't remember being searched for firearms.

I've never been, but if it's like many of the airshows (all military) I've been to, then you'll be on or close to the tarmac which is sure to be in the secured area. If so, then by law you can't carry there. And if it's not in the secured area, then I would think they'd have to 30.06 post it.

At airports not served by the airlines, there is no "Secure Area" where handguns are prohibited. I carry anytime I fly my own aircraft. Denton Municipal Airport (DTO) is not served by the airlines.

If on a military base, then it is Federal, so that is the restriction on carrying. For public airports, which Denton and Alliance are, the Tarmacs are not secure areas, but restricted areas. Unless you have to go through a TSA security checkpoint, then it is not considered secure.

So, bottom line, unless they are checking bags or screening you then you can carry. Additionally, Denton County (DTO) is owned by the City of Denton, so they can't legitimately post a 30.06 sign.

I emailed them specifically asking about CHL and they said it will not be allowed.

Now if they can't post 30.06 can they legally prevent you from entering with a CHL?

Well, by asking them you gave them the opportunity to give you notice, which means they don't have to post a 30.06 to keep you from carrying. Legally, you've been given notice not to carry. (I think)

I guess the only other option is if it is a city owned property, then they can't keep you from carrying in the first place..

Not a lawyer, yada yada.

PS- Don't you wish you hadn't asked them now?

It is city owned so they can't legally enforce 30.06. Even if they weren't, an e-mail response isn't an ORAL notice, so unless they responded back with the 30.06 language, it wasn't NOTICE.
4/13/1996 Completed CHL Class, 4/16/1996 Fingerprints, Affidavits, and Application Mailed, 10/4/1996 Received CHL, renewed 1998, 2002, 2006, 2011, 2016...). "ATF... Uhhh...heh...heh....Alcohol, tobacco, and GUNS!! Cool!!!!"

That's right, forgot that it had to be verbal notice. Still something to keep in mind when dealing with entities that aren't city owned and therefore can post 30.06....if you ask them about it, and they go look it up, they just might decide it's a good idea to start posting some signs to keep those nasty guns out of their business.

I like the "don't ask, don't tell" model pretty well myself.

Be sure to get the name of the individual who sent you the e-mail. Then ask him or her for their title and to cite the specific staute that gives him or her the authority to prevent Texas license holders from carrying there.

So you're saying no matter what since it is city property, they cannot prevent me from carrying?

Perhaps, but if they're wanding or checking bags and they find it, you won't win.

That's what I'm worried about. With three kids and a stroller the last thing I want to do is turn around and go back to put it in the car.

In all my years of going to airshows I have never been searched or seen anything other than someone taking tickets. Not even at Edwards Air Force base!!! I wouldn't worry too much about it.

Question: "So you're saying no matter what since it is city property, they cannot prevent me from carrying?"

What I am saying is exactly what I said.

They had a sign saying "No guns, No knives". Nothing other than that.
