Sit in the back close to the door for a quick escape if it gets rowdy. Would practice tactical awareness and avoidance.

Been that way since I came back from 'Nam, it comes natural to me.

Not owned by ISD, no class's held there I would NOT consider it a school and would be carrying.

I don't think he said it wasn't owned by ISD, just not a part of the school building. At least that is the way I took it. If it's the admin building, which is typically separate from the school buildings themselves(at least in most districts I've seen) it's still owned by the district and the no CC still applies.

A) obviously you're not going to move out of the HOA anytime soon, so you've got to go to the meeting and make sure they don't raise the fee (more on that in a sec)

B) I really like the idea of making the cops aware of the sit, let them know of the next date of a meeting and see if they can be there....Liberty Hill use to have a nutter who would come to city council meeting, and I meet this guy was off the charts crazy, the cops would be there (a couple of them) and he would typically end up escorted out) now this was years ago.

C) I would carry, remember, concealed is concealed...no one needs to know and if it ends up that you need it, well, then you need it and you're alive, I'll donate if you need a legal fund. Honestly, I'm betting the the guy is all bark.

D) about the HOA, get a look at their paperwork...which company is running your HOA? My HOA has a surplus. is there a real reason y'al need a raise? personally if ours would let us do a couple of things more frugally I think we could cut fees, but they insist we use bonded and insured people to dispose of trash in our playground I got on the board just so I could get some control of a little bit

I agree.. I always worry about the quite ones, that just sit there and stew and say nothing, not he ones that throw around threats.

While my first reaction was "that's not a school, it doesn't count", I've changed that opinion after doing some researching. Education Service Centres are the unit of the Texas Education system above school districts. Each RESC has school districts within it which it helps organize/serve. If a district owned building where classes do not occur counts as off limits, then ESCs would also logically be off limits. The rational for districts buildings being off limits, is that they are still controlled by a school entity and do school business. They are just the next step above the schools themselves. Likewise the ESCs are the step above the school districts. ESCs buildings are controlled by school related entities, and also do school business. So to be safe, I'd say anything directly under the supervision of the TEA would count as off limits. Just my two cents.

I doubt any students ever go into these buildings, but they are state controlled/created and under the authority of the TEA. I could also be entirely wrong, so this is worth what you paid for it.

Well, the issue in my mind is the statute language:

PC §46.03. PLACES WEAPONS PROHIBITED. (a) A person commits an offense if the person intentionally, knowingly, or recklessly possesses or goes with a firearm, illegal knife, club, or prohibited weapon listed in Section 46.05(a):
(1) on the physical premises of a school or educational institution, . . .

There is no legal definition of "educational institution" supplied within that statute, so I would also be concerned that broad definition like you describe above could be applied.

As a contrasting example, the Ohio code on banning guns in schools has language like, "“School” means any school operated by a board of education, any community school established under Chapter 3314. of the Revised Code, or any nonpublic school for which the state board of education prescribes minimum standards under section 3301.07 of the Revised Code,". Absent a definition, a "school" can mean just about anything. What about a cosmetology school? Barber school?

Ditto the comment on sitting as close to possible to the door, although if he does come in shooting you would be closest to him.
I am in no way advocating breaking the law. I don't think it has been established whether it's legal to carry there yet.
But I would be practicing deep concealment.

without due process. They enforce rules that get in the
way of your rights to your property. They can fine with no
recourse for simple little things like putting a religious orniment in a window.

As far as the creep at the meetings goes why doesn't the LEO arrest him for making terrorist threats
after all he threatens to use deadley force against speeders. Maybe the HOA can put in a few speed bumps
if they care about the welfare of their members which most HOAs don't.

OK, first I think you need to actually attend an HOA meeting and then learn a few things about the HOA laws in Texas and/or your particular city before spouting off about them. second, getting speed bumps are very expensive (ie, would deff require a raise in rates) and require the permission of the city and police, trust me we have speeders going through our community constantly in order to avoid a school zone, we've looked into it, so this is a very touchy subject, don't tell me HOA's don't care about people's safety our HOA can only levy a fine for ONE thing, forced mows, that's all, now, personally I'm completely fine with that...like I said earlier, I don't care for HOA's. look into the laws, see what they can do, I get the idea it's different in each state (I knew that), county and even city I didn't realize that, I thought the laws were by state.

I would agree that avoiding the potentially dangerous citizen is my first choice, but acknowledge the need to attend the meetings.

But I disagree with most of the people so far. The ESC is a separate governmental agency and is not part of any ISD. Since its primary purpose is to assist in the administration of schools, I would consider it more of a regulatory agency and treat it as such. By this, I mean I would treat and ESC the same way I would treat the TEA headquarters building in Austin. I do not think it would be considered a school or educational institution under the law. Obviously, the important person to consider in this is the local district/county attorney and his interpretation though.

Have you considered asking your local prosecutor how he would see it? I would not ask if he considers it a school, but ask him for how he would define a school or educational institution. I might give him a list of places to see, like a local high school, a local private school, a pre-K day care (especially if there is one with the "Montessori School" name or something similar, a driving school, the ISD admin buildings, a college, the student union building on campus if there is one, and then throw in the ESC as part of the list. It might be very interesting to get that opinion done in advance one day.
