Suspend ???

Post by tommyg »

If a Chl holder gets a warrant for His/Her arrest
Does Dps send a notice saying to the Chl that the CHL is suspended?
Do they revoke the chl immediately or wait until the outcome of the case
Are felonies and misdemeanors treated the same
Note I’m not in any trouble just want info

If charged with a class B misdemeanor or greater, the CHL is suspended until a disposition of the charges is made.
If the charges are dismissed, the license is again valid.
If convicted, the license is revoked because the holder would no longer be eligible.

It is my understanding that the answer depends on what agency executes the arrest, and whether they follow thru with DPS. There is a form to fill out (by the arresting agency/officer) to inform DPS of the issue. If this form isn't filed, then DPS is unlikely to become aware of the issue to suspend the license.

That being said, if you were to subsequently get into trouble with your firearm, the fact that the license "should have been" suspended might become an issue.

(I know it isn't "you"... ;-) )
