Will a Drug Paraphernalia Charge Prevent me from Renewal?

In January of 2011 I was arrested for a bull drug charge. I hired an attorney. To make a long story short, the possession charge was dropped to a paraphernalia charge. I received a 3-month non-adjudication of guilt verdict, which has since expired. However, it was time for me to renew my license. I took the class, submitted the fee and the State responded to me stating they need all of the court documents from this arrest and outcome.

Before I bother going down to the courthouse to obtain this information to send to the State I was wondering if anyone on this site knew if the State will still deny my request for renewal based on the guilty plea of drug paraphernalia. I appreciate your informed and educated responses!

What class of misdemeanor was it?
A, B, C?

Also, if you have already done your renewal class, and paid for your new application to the State, paying another $10 or $20 (probably) to get the documents to get the DPS answer, rather than speculation here may be worth it.

But if it is a Class C you should be OK, if an A or B, you may have to wait a while for a certain period of time (maybe 5 years) to elapse.

Well, a paraphernalia ticket is a Class C. It's not a case of the $10 or $20 for the files. I just do not have the time to spend a day at the courthouse if it's only going to be a waste of time. You know what I mean? I appreciate the info!

I typed in an acronym and it placed bull there.

I'm guessing he didn't do drugs, but was in the "possession" of someone else's paraphernalia that had residue which was why the charge was originally for drugs, but the attorney got it just knocked down to possession of paraphernalia?

Easy does it. You received some very good information/advice based on what you told us.

1st - information - Class C shouldn't be a big deal. A or B you might have made a $140 donation to the State.

2nd - advice - Violations of forum rules can lead to a short membership. That's why the filter is in place. Don't be too hasty in chastising the membership, that can also lead to an early membership demise. If you will note, a legitimate question as to what was a "bull drug charge" was made. Unfortunately not all of us know all the terminology of the drug or legal world so we have no idea what a bull drug charge is. Your response and a couple of others were made at approximately the same time so they were trying to work it out while you were explaining why the filter caught you.

Mind your P's and Q's and someone will be by with more information or you can clarify the previous question as to what degree was the charge.

3rd - my own piece of advice - stay away from drugs, paralhernalia, and those associated with it...especially if you are a CHL holder...and this will not be a problem.

And, if you stay around long enough, you will find there are a lot of geniuses on the board. Very wise men and women that are more than happy to help if you'll give them the chance.

Its your choice to spend all day

if it is a Class C as you state, then you are not disqualified.
Its totally up to you if your 2nd amendment rights are worth a day at the courthouse.

Kind of rude don't ya think, as the very first response you got was the right response, and gave you the information you desired.

Why not stick around, learn something and understand why others made the various comments they did (because the first answer was right, why would they give any other advice?)
And yes, we do like our forum, we respect the forum and the members on it, including yourself as a member, please respect us back by following the rules set forth and yes, sometimes you have to take the comments like "whats a bull drug charge?", or the other comments. They are, in my mind, simply there, as we all take (or should take) responsibility for our actions, and in your comment that it was a "bull drug charge", is not taking responsibility, its like saying "but officer, I was only going 56 in a 55. Well, it is still speeding, and if I got a ticket for 1 mph over, I would own it.

Just make a phone call and ask the DPS about it. If there is a record they will find it anyway
The worst that they can do is tell you that you will not be able to get your renewal.
If they say no then you will have to wait or get a lawyer to get it cleared up.

Max - you have the advice above on your issue. Here is a little grandfather advice based on stuff and life experiences that you have no idea about. If you are that close to drug culture - you need a lifestyle change and new friends! Best of luck with your problem and welcome to the forum.
