Buying a shotgun and filling out the form
Hello all again. I am asking quite a few questions lately and appreciate all the answers. One more question for now... I want to buy a shotgun and that means filling out the transfer form again. Now this year I have purchased a XDm and Taurus 85. Would buying another firearm put me on some sort of list? I remember when I took my CHL class the instructor said he said he had to fill out a special form to explain why he was buying many guns but for him it was that he had a class.
Any help is appreciated since if this will put me on some interesting list I'll wait on the Mossberg 500.

That only happens when you buy several guns at the SAME time.

Nope, you're good. I've bought more than 3 in a year and no visits from cops or ATF.

The only time multiple gun purchases are recorded is if you buy more than one hand gun in a week from the same dealer. You can buy every long gun on the shelf and never get put on a list. I have worked in several gun stores through out the years, and i have had to fill out those BATFE forms befor. As the buyer you never see them, but we record it.

I agree. For some reason I am pretty sure it counted for lower receivers, which is a pretty plausible purchase of $300-400.Mike1951 wrote:I agree. To the best of my knowledge all that stuff was over turned, Voted as unconstitutional or something along that line.

Allow me to straighten things out a bit. And remember, this ONLY applies in Texas, I'm not gonna be a spokesman for other states.
1) Buying two or more handguns within 5 business days will result in the information being sent to the ATF, where that information goes isn't really known, but now they have your name and address and serial numbers of your handguns.
2) Buying two or more semi-automatic _rifles_ of caliber > .22 (i.e., .223 and above) is pretty much like buying two or more handguns. Reported to the ATF.
In both cases above, it means nothing more than the fact that the ATF has that data. They likely use it to collect statistical evidence. That is, if you're buying 100 rifles a month, you'll catch their attention. Now we all know that people aren't that dumb, but that doesn't stop the ATF from wanting to play "Fast and Furious 2"

In all other cases, the 4473 form STAYS with the FFL. Nobody else has the information about what you have purchased. Shotguns, for instance -- buy a million, they don't care (yes, that was hyperbole

In almost every situation, your purchase history stays with the FFL. We have to keep that form for 20 years though, and the ATF _does_ inspect us on occasion, which includes perusing the 4473s and A&D logs, but it's generally to see if there's clerical errors. If they come to an FFL digging for a specific name, they better have a search warrant.

Just Texas? I thought it was the four border states, Texas, New Mexico, Arizona, and Kommiefornia?

Each state varies in the rules and regulations they impose (or, in the case of Texas, DON'T impose) on FFLs. My point is that I'm only versed in the Federal laws and the laws of Texas for firearms, and that I can't speak for what the rules are an FFL has to follow in other states.C-dub wrote:Just Texas? I thought they were new rules imposed by the BATFE regarding the purchase of rifles greater than .22 caliber in these four states. Can any FFL tell us HOW you were informed? did BATFE send you a notice and instructions? If so is it public or are you willing to share the directive?
