They can require it in exactly the way they say: "as a condition of continued employment."

Which means if they want to search your car, there are three outcomes:
1. You quit on the spot, at which time they no longer have any right to search.
2. You refuse the search, and they fire you for refusing.
3. You allow the search, and they fire you for having a gun in your car.

Obviously Option 1 is the best choice.

I suppose there's a fourth possible outcome: you consent, and they don't find the gun. I don't think I'd take a chance on that one.

They can set any company policy they want, provided it isn't in violation of laws (for example, they can't refuse to hire someone because of their race or creed). Saying you can't have it in your car isn't a violation of law, and they can fire you for it, but it isn't a criminal offense. Of course, they can fire you for any reason, or for no reason at all. If the employer parking lot bill becomes law, they can't fire you for having a firearm in your car, but they could still find innumerable other reasons to fire you.

yeah, the parking lot bill is my new baby. I don't read most of those HB5150 threads cause, well, I'd rather pour lemon juice on a paper cut than read that dry material.

My company seems to be anti-CHL but at least they are giving me an "out" to have it in my car. The problem for me is I car-pool with my wife so she has the gun :sad:

The other funny item is more that 50% of our business has to do with supporting different branches of the military.....


POLICY
Carrying firearms, incendiary devices or any other weapons on Company premises or while conducting Company business off Company premises is strictly forbidden. Although the Company does not routinely search employees’ work spaces, the Company does retain the right to search all Company property at any time.

PURPOSE
To provide a safe working environment by enforcing that no employee is permitted to carry a weapon to his/her work area under any circumstances.

RESPONSIBILITY
It is the responsibility of the Human Resources Department to implement this policy.

PROCEDURE
This policy is applicable to all locations and employees.
While the carrying of an unconcealed weapon (i.e., a gun) is permitted in various states and a license to carry this type of weapon is not required by law, employees or visitors may not enter the facilities with any type of weapon, including a gun.
Should a visitor or employee with a weapon, including a gun, wish to enter the property, the weapon must be left in the locked vehicle of the visitor or the employee before he/she may enter the facility. If a visitor or employee refuses to leave the weapon in his/her vehicle, the local Office Manager (Or Human Resources Administrator in the absence of the Office Manager) is to inform the persons, visitor or employee that he/she is violating Company Policy. If he/she does not leave immediately, the police will be called and the Company will determine whether or not to prosecute the individual.
In the case of a concealed weapon, any employee who determines or speculates that an employee or visitor is carrying any kind of weapon should notify his/her supervisor who, in turn, will notify the local Office Manager (or Human Resources Administrator in the absence of the Office Manager).
The local Office Manager (or the Human Resources Administrator in the absence of the Office Manager) will approach the individual in question following the procedures for this type of incident. Employees must NOT get involved.
Employees should in no case disarm another employee or visitor.
Any employee found carrying a concealed weapon will be turned over to the police and will be subject to disciplinary action which may include termination of employment.

Just re-read my companies policy on firearms:
[company name] does not tolerate violence in the workplace. Workplace violence is defined to include:

Bringing firearms or weapons of any type or kind without the proper licensing onto [company name] premises, in [company name] parking lots or while conducting [company name] business.

SANTA CRUZ, California - A gunman opened fire at a wastewater facility Friday, killing a man and seriously wounding a woman before killing himself, according to police.

The shooting occurred around 7 a.m. at the Lode Street Wastewater Facility in the Live Oak section of Santa Cruz, Sheriff's Sgt. Fred Plageman said.

All three were employees of the treatment plant, he said. None of their names were released.


The woman tried to escape in her car but was shot multiple times, police said. She was taken to the hospital with serious injuries, police said. More than one gun was involved

Police said co-workers described the shooting as the result of a love triangle, but additional details were unavailable.

"It appears that there is a relationship between at least two the people involved," Plageman said. "At this time what we're trying to do is contact family members."

More than 30 law enforcement officers searched the scene, but found no additional suspects. Several witnesses also were being interviewed by investigators.

About 40 people work at the Lode Street facility, which is operated by the Santa Cruz County Sanitation District and processes sewage from Live Oak, as well as the nearby towns of Capitola, Soquel and Aptos.

But with all those gun control laws in Cali how does this still go on?

I'm shocked. They should do more to keep guns out of the hands of people and things like this wouldn't happen....
