Who Do You Call Again For Improper Business Postings?

I dont remember who to report improper signage to?

Was it TABC?

Anyway, a local restaurant has a "The unlicensed carrying..." sign right up next to a "51%" sign.

Its a mexican restaurant and no bar. Is it worth letting someone know about it?

That is correct, the TABC.

And yes, let them know. They usually are very responsive about improper signage.

Wow! I just got off the phone with a Seargant (supposedly) in charge of signage in my county.

I told him about the two signs and how i was pretty sure that they dont receive 51% of their profit from the sale of alcohol.

I told him that i loved their food and that i would surely like to be able to carry but due to the sign, im not allowed to.

He says " But they have a liquor license", I paused and said "OK". He says, "So your alleging that they dont recieve 51% of their profit from alcohol sales" I said " Yessir thats correct, from my experience, bars are mostly the ones receiving that much of their profit from alcohol sales".

He says, "Well how are we suppose to know that without an audit?"

My eyes opened in disbelief that those words were coming out of his mouth.

I replied, "Thats why im calling, i was under the impression that you guys would be the ones to know and regulate the proper posting of these signs. "
I think he got upset and said that he would send an agent to check it out.

I was NOT convinced he was on my side.

Im sorry, yes i said sales.
But yes, it looks like you had the same confusion i had. These guys dont know or seem to care if a business is actually a 51% business or not.

It strikes me weird that these TABC signs are not regulated with more scrutiny.

TABC does care about the signs and regulates them to the best of their ability. Most of the agents I have talked to are more than willing to file a case on any restaurant or bar owner who has the wrong signs.

Dihappy, can I ask you which county that was so I can check which sergeant it was? We don't have sergeants in charge of signage, but we do assign all responsibilities to people by county. I can at least make sure he knows how to read the license to see which sign is correct. The agent does not need to do the audit to check for proper signage since it is on the permit.

But we do the audits to verify it. The agents don't do them, but we have a staff of auditors in the compliance section that do. The accountants check for many things on this, especially the tax paid, but they do verify the sales reports by category to verify the 51% too.

Also, if anyone ever has a complaint about any TABC personnel, please feel free to report it. You can ask for his supervisor, you can call the regional office and speak to the captain (regions are San Antonio, Austin, Dallas, Houston, and Lubbock), or you can call headquarters directly. at HQ, you can talk to the supervisor in charge of the division (enforcement or compliance mostly) or you can talk to the Office of Professional Responsibility (IA for us old guys).

SR,

Thanks for the info. I wish i would have written this "Sergeant's" name down but i didnt.

Anyway, i wish this guy was as knowledgeable and helpful as you. This was the Hays County office that i called, i think it was here in San Marcos also but not sure.

I saw on your other post that they can easily tell if they are 51% just by looking on the permit. That seems something every one at the office should know.

Let me know if you find anything out.
