In McKinney, at least for now, the public schools are colocated with city parks. There are no fences setting off schools from the adjacent parks. My question is would it technically be a violation of CHL to carry in the park ? Specifically - if the kids from the elementary school are in one part of the park playing soccer and I am in another part of the park 200 yards away?
From what I read:
On the physical premises of a school or educational institution, any grounds or building on which an
activity sponsored by a school or educational institution is being conducted, or a passenger
transportation vehicle of a school or educational institution, whether the school or educational
institution is public or private
the on any grounds clause could be interpreted to include not just the school premises but the entire park itself. I highly doubt McKinney PD would enforce this, but I wonder if it has come up. It would seem clear cut (lol) that as long as it wasn't recess and no kids were out concealed carry would be permitted in the entire park, but as soon as one kid kicks a ball as part of a class/recess, concealed carry flips to illegal.
This of course strikes me as completely arbitrary and capricious...

If you are not there with the school or with your child during a school function (lunch in the park with your kid during the school day, carry away.
