They are already written like this, and have caused problems for people arrested under weak circumstances as family violence arrests really screw up your ability to posses a firearm. I'm not sure which changes you would make, but what you describe is the current status quo.baldeagle wrote:We have profoundly stupid laws in this country regarding spousal abuse. If there is any evidence of spousal abuse, the police should be able to arrest the perpetrator on the spot, and the abused spouse should have no say in the matter at all....

Essentially what our laws reveal is that it's perfectly fine to beat your spouse repeatedly. Just don't beat anyone else. It's a neanderthal approach to the problem.
A former supervisor (In LEO life) was arrested under such a law. All charges were dropped and spouse did not want to prosecute, but the letter of law did him in.
A bit of an aside, but if the abused party awould take the kids would leave, that solve many problems (not all).

Anyone else considering the scenario that, since he was accused of domestic violence, he was not allowed to possess a firearm and therefore could not defend himself or his children from his crazy wife?

The choice to murder her children makes me wonder which spouse was abusive.

Is that true? I'm not sure that is true.Jaguar wrote:Anyone else considering the scenario that, since he was accused of domestic violence, he was not allowed to possess a firearm and therefore could not defend himself or his children from his crazy wife?
The guy was accused of pushing her? And that got him arrested? I've never pushed or even raised a hand to my wife or any woman, but that seems a bit over the top.
Anyone consider she may have been dealing with a bit of hypothyroid related depression or dementia? Either one of those can do some freaky stuff to a person's perception of reality.
I am not and have never been a LEO. My avatar is in honor of my friend, Dallas Police Sargent Michael Smith, who was murdered along with four other officers in Dallas on 7.7.2016.

I have no idea if it is true. What is know is she called 911 to complain about being pushed. He was arrested and plead guilty to a Class C Misdemeanor. He was then barred from possessing firearms. She then shot and killed him and their three kids.C-dub wrote:Is that true? She was crazy, I believe we can state this since she murdered her spouse and children, and committed suicide. How that manifested itself in the relationship, the complaint, the murder and suicide is not known. He could have been co-dependent on her mental status and went along in an attempt to protect her - unaware of the depths of her illness.
We don't know, but we do know the man was disarmed by the system and then murdered by the very person who was responsible for disarming him. He may have not been the type that carries a gun, but if he was he couldn't carry legally after the DV complaint.
