Being in fear for his life he shot because they moved after he warned them stop. The question of whether Horn would have been justified in shooting based on protecting his neighbor's property wasn't tested as you alluded. This compares to the joe Horn case in that both parties shot a BG that was not actually breaking into their homes(castle). The difference in the two is Joe Horn was smart enough and lucky enough... Maybe both.... To leave no witness to give a different story. Joe Horn could argue he felt threatened. This guy cannot really do that.

That is pretty much were I am on it all. I have insurance for this very reason. Last night some of the neighborhood teens pulled a prank. They took Christmas decorations from some of the homes and set them up at other homes. Personally, I thought it was pretty funny. The part that is not funny is knowing there really are guys out there with itchy trigger fingers who might have gunned these teens down. Sad world we live in.

I live in Pasadena and wasn't too broken up when two career criminals were removed from the gene pool and the cops I talked to weren't either. But neither you nor I nor the police get to decide, the courts do. So like Joe Horn the guy in FW will have his day in court and there will be a lot of discussion no matter which way it's decided..

Oh... And if it helps, I apologize for bringing up "ole joe". I am sure he is the salt of the earth. The comparison was simply meant to be that both people went outside their homes to stop what they perceived as bad guys from stealing property and shot the bad guys while claiming they feared for their lives. If you read my original post, you will see that I posted I believed this guy would get away with it too.
