Need Help Check elegibility.
Hello,
So I know you guys are tired of seeing this type of post but I really do need help, and I may have to contact a lawyer if you guys cant help.
4/01/2008: I was arrested for Attempted Malicious Wounding
The charge was then amended to Assault and Battery
12/15/2008: Plea submitted Nolo Contendere for agreement of 150h community service to be done within 12 months supervised probation for the charges to be dropped
12/7/2009: Charged were Dismissed
I can't figure out through online Lit if I am eligible yet?

I was thinking of just going into a local police station and asking with my court papers in-hand but I was not sure if they would help me.

I don't think that would help. Have you checked the DPS website for all eligibility questions? For example domestic violence, drug and alcohol addictions and psychological conditions can affect eligibility for obtaining a CHL.

Ask ten people and get a dozen opinions. Here's one more. I think you have to wait until December because your arrangement sounds like deferred adjudication.

There are no other issues that will effect my eligibility, this was an isolated incident. Don't even have a traffic violation past this mistake.

There was never an official "Writ of deferred adjudication filed" to my knowledge, there could of been unknown to me, but yes I do believe it technically was.tbrown wrote:Welcome to the forum.

I believe the date is based on the conviction, rather than the sentence. Since the conviction was 2008, five years has passed so you are good to go.

So assuming that this offense is counted as a deferred adjudication w probation the wait period is 5 years even though they look back 10?
