Thanks for eveyone's concern and advice. Fortunately, we keep our grandson a lot of the time. It's a real sad story, when she was married, her and her ex had a booming business, sales approaching $1M. Then she found out he had problems with strip clubs and alcohol and he didn't want to quit it - the business was lost along with their assets. He basically now lives on the street, just because he doesn't want to pay child support. No wages to garnish, no assets to seize, etc. She has contacted the AG, but things are slow, as has been mentioned. She is working hard to get out, knows she has caused us lots of heartache and cost, and I believe that's the reason she doesn't want to "burden" us any more by moving in with us. All we can do is keep bugging her and offering - and pray. Thanks again for your concern, it is truly heartfelt. I'll let you know if there's any news.

You have a situation here and an opportunity to win for your daughter and the rest of your family. You may need some help on this one but DO NOT EVER GIVE UP.
Seek the guidance NOW.
Generate a PLAN.
Generate a backup PLAN.
Cover all possible events that COULD GO WRONG with a plan.
But most important ;

SELL THE IDEA THAT SHE MUST LEAVE WITH YOU.
SELL THE IDEA THAT THIS DECISION WAS HERS.
YOU MUST INSURE THAT THIS WAS HER IDEA.
SELL IT !

YOU CAN DO IT!

I will pray that you and your family will soon know comfort.

since when is being in fear of your life a justification for deadly force?

Making threats will backfire. Using deadly force when not justified helps no one.
TX, quit being the voice of reason! Even though you're probably right in this situation, maybe it will make him feel better or get a chuckle at least. I'm not trying to make light of it either. Things used to be solved a different way, with a good old country butt whoopin. Those were better times in my opinion. If I felt like someone I loved was in danger, I would probably take matters into my own hands.

1. I suggest you point out to her that all stories behind a domestic homicide normally start out with this kind of thing.
2. I suggest you tell her it’s not a matter of "want to go" it's a mater of "needs to go now"
3. It would not hurt for you to call and ask the authorities where she lives if his action are lawful, may not do any good, but I can’t see where it would hurt any thing.
4. You might add even us "gun happy NRA fools" think he has a gun problem.

So if you had someone pointing a handgun to your face, you would not be in fear of your life????? I darn sure would be. So this is why I said what I did. She was in fear of her life. A good old country butt whoopin would be nice and a good thing to do, but some ladies can not give a whoopin like a man can. As I said some ladies cannot, but some can. Did not want to make someone mad for what I said.

If a BG busted into your house and you shot him, you will call 911. You would not just say "I just shot someone". You would go into a story that you were in fear for your life and he made me shoot him. He had a gun and was going to shoot me, I was in fear for my childrens and my life.

I think you misunderstand. The good old country butt whoopin' comes from family and friends of family in these situations. I know it's happened before and the guy usually goes away quickly. Those were different times and small towns though. Now we have all of this "peace and love" bull. People can get away with all kinds of horrible stuff these days.

I think with the "Fear for your life" argument, it's not actually law that says you have to be afraid for your life to pull a gun or even shoot someone. If you ever have to shoot someone you tell the police what happened and then say that you shot to "stop" them from killing you or a loved one or whatever the situation was. Now, if you have to empty a clip (or shotgun) to stop them, then so be it. You are right though, if someone is pointing a gun in my face, I'm going to be afraid for my life. There's no doubt about it.

Being in fear of your life might be your emotion during such an event, but it is NOT a legal justifcation. The law is very clear, and that phrase (even that concept) never appears in the law.

I would say I used deadly force to stop his illegal use of deadly force against me.

I can think of many situaions where I would be in fear of my life, but I have no justification for deadly force.

Oh I think peace and love is a great concept. Unfortunately a lot of people in the world don't, so I'm not taking any chances.

1. This is not about her. It is about the right of a minor child to a safe life.

2. Call your local domestic violence hotline and get some referrals for mental health and legal assistance. Follow their advice.

3. You are not morally bound to correct the mistakes of your adult child.

4. You are morally bound to protect the minor child.

5. Trust in Jesus with all your heart.
