Backgrounds come out during follow up investigations, and even gangbangers sometimes tell the truth for their own reasons.

On scene arrest decisions are made on probable cause on the basis of what can be ascertained at the time.

The one indisputable fact in this case would be the bloody body on the ground.

It would be foolish to put one's freedom at risk by betting on the presumed outcome of police interpretation of a he said / she said contest.

I would have called 911 first and if I shot it would be a warning shot only to the surviving BGs.
