Being pedantic here, the jury may find you guilty, but the judge determines the sentencing.
I forgot about the jury, but don't they also determine the sentence in some cases or is that just how much the loser must pay in civil trials?

The recently convicted can choose to have either the jury or the judge determine the sentence.

Your might the surprised. If the defense feels the law in the case is black and white, or that there is case law that sets precedence, they will request a Judge ruling vs. a jury that might be swayed the opposite direction of what they would want.
