CHL holder around someone on probation?

Hello,

I couldn't really find any information about this subject. I would not be effected anyway by law if I live/carry with my girlfriend, who is on probation correct? I would assume that I wouldn't be effected in any way since the firearm would never be in her possession.

Thanks for any input on this subject

No law says you can't carry around a probationer or parolee.

Probation and parole officers often tell their clients that they can't be in the same room as a firearm, and similar things. IMO, and I am not a lawyer, I think they are trying to make absolutely sure the client does not have access to a weapon.

Obviously you can't leave firearms lying around the house.

If you live together I think you would need some kind of safe or lockbox to make sure she didn't have access to it when you were sleeping or otherwise separated from the gun (showering?).

If you are simply dating I see no problems if you carry the gun on your person.

Thanks for the replies,

Yes we live together and have been dating for awhile. She is on probation(defered judification) for something minor and it doesn't effect my opinion about her.

But we discussed today about if it would effect my CHL in anyway?. Or if she would possibly be violating her probation at all by being around me carrying? I am mainly concerned and wanted to make sure that I was not violating any laws by carrying with her all the time. If anyone has some more opinions on this I would appreciate it.

I don't think it would Affect your CHL, because you're not putting the handgun in their access.
leaving it on the nightstand might be different, but in your holster should be fine.

If she is on prob for a misd, then it is no problem for her. If she is on prob for a felony, even if deferred - then she can't have the firearm in her possession, or her available possession. Even w/o the conviction, this is a standard condition of probation here in Texas.

U need to be able to lock it up when U are home - and she can't have access to it (if on felony prob).
