Removal of 30.06 at public school

Post by age_ranger »

Ok, so we all know that the posting of the 30.06 sign at public schools is not legitimate, right? Is there a way to petition to have them removed? My family and I are members of TSRA and just read about the school zone signs in a recent article of their magazine. After explaining this to my son (signs posted at Haggard M.S. in Plano) he would like them taken down (as would I) since they appear to restrict a valid CHL holders right to carry a firearm on school property.

I'm not a lawyer, but I believe if the school is a government owned facility, then 30.06 signs have no legal meaning. It may be easier to point that out to the administrators than to get them to understand your right to carry. Of course, that's all moot if either a) it's a privately owned school, or b) you don't want to deal with the possibility of getting arrested/hassled.

Of course, check this out with a lawyer before doing anything, blah blah blah.

You could always write the ISD a letter, but I wouldn't expect much ato result from it.

Basically, signs at the entrances to the buildings are redundant but harmless in my view. Signs restricting access to parking areas, sidewalks, grounds, etc. are not legally enforceable.

You can tell them this if you want but I'm pretty sure they will just blow you off.

Where are the signs posted? It's a silly question, since 30.06 signs are invalid on government property, but I ask because if they're posted at the entrances to buildings, they at least properly mark the boundaries for legal CHL carry.

I believe the article has picture of the sign posted at the entrance to parking lot at a school in Friendswood.

Plano ISD has put up a sign at the entrance to the parking lot at several schools.

After past dealings with the Plano ISD safety office on another subject, I can just about say for sure they will not be willing to take them down. They are extremely paranoid of liability issues and their legal staff has them running scared about lawsuits. Being from Plano and some of the sue happy folks here, I can see part of their concern. The signs provides them something they can point out to the antis and sheople to make it look like they are prohibiting guns on school campuses. I have spoken with a few parents asking them what they think, and they believe the signs are a barbed wire fence for all gun carriers. I would be willing to say 98% of the population feels that way.

The signs are posted at the entrances of the parking lots. What really bothers me is that they tell the students that no guns are allowed ANYWHERE on the school grounds. Not sure if this is to make the kids feel better or simply a matter of them not knowing what the actual laws are. If anything, maybe we can educate them on it.

My opinion on this sign issue is to understand they are not valid, but not bring the issue up with the schools. They could decide to make a test case out of someone who brings up the question. Best to ignore them, educate the CHL holders that they are not valid and if the issue comes up, then challenge the signs if required.
