Buying a gun in texas...

Post by AFJailor »

My father-in-law was moved by his company to California a few years ago and will be moving back to Texas soon and a buddy of his told him that once he becomes a Texas resident again he will have to wait 1 year before he can purchase a firearm. Is there any truth to this?

Possibly, if he doesn't have enough money to buy a gun for a year.

um... I may be wrong, but on day 1 he can go to DPS, say "I am now a Texas Resident" and get his texas drivers license, and go buy a gun.... and not just those Kalifornia sissified politically correct guns either, but REAL weapons.... like a free man... God bless Texas!!!!!!!!!!! :patriot:

90 days. Provided he's a American citizen or green card holder who has no criminal record.

Interestingly, they don't check for any additional record if you just answer "Citizen" on the form, but if you don't they often ask for proof of residency such as 90 days of phone bills under your name.

Funny thing is, how many of you still has land line nowadays?

I've never been asked for proof of residency, just check No in a bunch of boxes.

...It might be funny to go in to buy a gun and check yes on everything from being a fugitive of justice to having renounced your citizenship and what not just to see the expression on the clerks face

The first firearm I bought in TX was with an IL driver's license as an ID, all I did was show the energy bill from the RV park that I was living in while we sold the house in IL. I had not yet "officially" moved to TX, IOW changed my DL, etc, because we had no permanent address here.

Actually the 90 day wait only applies to aliens. If you have a home in or intend to establish one here you are a resident of Texas, according to the instructions on the 4473 for "State of Residence"

All nice and dandy. The problem is that nobody is required to show proof of citizenship, which means any illegal can walk in and claim to be a citizen.

This would the loophole I would like to close.
seamusTX wrote:A U.S. citizen who is a resident of any state can purchase long guns from an FFL in any state.

A U.S. citizen can purchase handguns in his state of residence, with no time limit, if he can convince a dealer that it is his state of residence. A driver license will do the trick. Other documentation such as leases may work.

A legal resident alien must be a resident continuously for 90 days.

http://www.atf.gov/firearms/faq/faq2.htm#b11
The State of residence is the State in which an individual is present; the individual also must have an intention of making a home in that State. A member of the Armed Forces on active duty is a resident of the State in which his or her permanent duty station is located. If a member of the Armed Forces maintains a home in one State and the member’s permanent duty station is in a nearby State to which he or she commutes each day, then the member has two States of residence and may purchase a firearm in either the State where the duty station is located or the State where the home is maintained. An alien who is legally in the United States is considered to be a resident of a State only if the alien is residing in that State and has resided in that State continuously for a period of at least 90 days prior to the date of sale of the firearm.

Stupid wrote:All nice and dandy. The problem is that nobody is required to show proof of citizenship,
In the year 1968, anyone with cash in hand could walk into Sears or any number of now-defunct department stores or hardware stores and buy a handgun, rifle, or shotgun with no questions asked, other than, "Would you like some ammo with that?" Or they could use mail order.

In subsequent years, the crime rate soared. It began to decline in the early 1990s, but it has never been as low as it was in 1968.

Cause and effect? You decide.
