My company just switched professional organizations (think an outsourced HR / payroll department for small companies) as of 1 January and I was just making some coffee and noticed a properly worded 30.06 sign in the break room. Now, it is no where near big enough to be legal and nothing has been said verbally so at this moment I can legally carry. I would be VERY surprised if the president of the company is anti 2A as I know most of the development organization shoots. And the development team is half the company. I don't know if anyone else here has their CHL, but it wouldn't surprise me if they did.

Now for my dilemma... Do I ask? I think I have to in this case. I also think that I can do this right so there are no problems, but I really like this job. I just don't know how much leeway we have with the professional organization.

A properly worded, if not properly sized, sign in the break room? What are they preventing carry around, the donuts?

I think I would find a way to question the sign anonymously, after all, it might just be someone's twisted idea of a prank.

No prank here. Our new professional organization requires that sign to be posted, but the office manager doesn't actually agree with it. I asked and she likes the fact that I carry (her husband does as well) but she can't tell me that it is okay. She specifically did not tell me that it was not okay though. So I offered to exactly follow TPC 30.06 and she agreed that we would leave it at that. And since the sign is about 1/3 of a sheet of paper in size (including company heading) I am just fine the way I am.

I believe employers are exempt from having to have a proper sized sign.

No exemption for employers. The sign is compliant to 30.06 or it's not. Although close to compliant is probably 'good enough' for all practical purposes of whether you may take a ride or not. IMHO. This one sounds like it's not even close.

You believe incorrectly. It is a policy and I could be fired for it, but I cannot be arrested since no crime has been committed as the statutory requirements have not been met.

That's why it's called a "C"(oncealed) HL.

Get good at concealing. Become an expert at concealing. Be the concealment god. As long as you keep your mouth shut and there's no metal detectors, I'd say at that place you have no problem.

Deep concealment is very easy to do. I've been carrying for years and it shocks most of my close friends when I tell them that I'm carrying a 9mm & 46 rounds of ammo. They can never tell.

No problem with concealment. And I can do an S&W642 and/or Officer 1911 with spare ammo and never be noticed. Been here for 5 months now and nobody guesses.

Just playing devil's advocate here for a minute.

IIRC, it has been argued in other threads that written warning is valid in an employee manual if it contains the proper text from 30.06. I know of very few employee manuals that are 20" x 30", so I'm assuming the text in the employee manual did not meet the size requirements of 30.06.

If 30.06 wording in an employee manual would be considered valid notice, it's not a stretch that a company posted, too small, 30.06 poster would also be valid.

(3) "Written communication" means:
(A) a card or other document on which is written
language identical to the following: "Pursuant to Section 30.06,
Penal Code (trespass by holder of license to carry a concealed
handgun), a person licensed under Subchapter H, Chapter 411,
Government Code (concealed handgun law), may not enter this
property with a concealed handgun"; or
(B) a sign posted on the property that:
(i) includes the language described by
Paragraph (A) in both English and Spanish;
(ii) appears in contrasting colors with
block letters at least one inch in height; and
(iii) is displayed in a conspicuous manner
clearly visible to the public.


So yes, valid "written communication" can be less than the full size sign, but to be prosecutable you'd have to show that the employee was provided the "written communication" with the exact wording. A bulletin board in a break room probably isn't going to pass scrutiny.

You are mostly correct. I believe however that you can be arrested but is a defense to prosicution. Could be wrong but I think you could still take the ride.
