Police stealing your ammo?

Post by Doug.38PR »

A co worker of mine told me a while back that he used to have a CHL and carried. He said a Houston Policeman pulled him over once, presented the officer with the CHL, the policeman ask to hold the gun, the CHL holder complied, the policeman took the magazine out of the Glock, and then took the ammunition out of the magazine.
After the exchange was over the policeman handed the CHL holder back his magazine and gun...but kept the ammo. The CHL holder said "wait, what about the ammo?" the officer told him "We're not allowed to return live ammunition." :headscratch :confused5
Is this legal?

Did the officer give your friend a receipt for his seized property?

It sounds like theft to me.

GC §411.207 gives peace officers the power to disarm a CHL and states that the officer "shall return the handgun to the license holder before discharging the license holder from the scene if the officer determines that the license holder is not a threat..."

No ne did not get a reciept.
This was some years ago as the CHL holders license is now expired and he "forgot to renew it so now" he's "gotta take the course again."

Actually I recall someone here posted they had a friend from out of state who had the same problem while visiting here in Texas, I think they were from Louisiana. This happened about 9 months to a year or so ago IIRC.

I read it too, awhile back. Same exact thing. I even double-checked the date because I thought that an old thread had been dug up at first. Same poster?
