Suppose someone's wallet is lost or stolen. They can go to a DPS office and get a temporary DL the same day but there's no temporary CHL and it could take weeks for a replacement to arrive in the mail. However, as of 9/1/2007, the Motorists Protection Act made it clear that law abiding Texans may carry in their cars.

Suppose they choose to carry a gun in their car like any other law abiding Texan. If they get stopped while waiting for the replacement plastic, it's impossible to "display both the license holder's driver's license or identification certificate issued by the department and the license holder's handgun license" as required by the concealed handgun law. Can their license be suspended?

ooooo....good question.

I would think that you could still carry in your vehicle as long as you reported to the DPS that your CHL has been lost.

No license, a CHL holder can get slammed. Will they, some will and some will not. The law states that a license must be with the CHL holder and displayed if they are asked for ID and have a handgun. Doesn't take "car carry" into account yet. I would not carry without a CHL on my person.

CHL laws need to be changed to allow CHL holders, inside a vehicle, to be looked on as it is with "car carry". No requirements to inform or have a CHL to display. That is the only way to equalize the CHL holder with the general public in my opinion. Otherwise, we are not equal under the law for the same activity. That is unjust discrimination by the state. That is my opinion.
