Face to Face Transaction
Hi everyone, I have a question, I will be trading a shotgun and another rifle to another individual for a straight up trade for a rifle he owns, we both live here in Texas. Do we need to do a Federal firearms Form for this? I am not sure how the law works on Face to face transactions as I want to do this the legal way.I will be making the trade this sunday so quick responses will be greatly appreciated. I am a CHL Holder and he is not. I have discussed this with him and he was saying something to the effect of swaping copys of Drvers Licences! Is he correct? Once again Thanx YALL.

Re: Face to Face Transaction
No need for FFL Transfer - not required for transfer from individual to another individual of the same State. Does not even have to be FTF, you could ship the gun to someone in your own State without an FFL Transfer and be legal.
The wording of the law is basically "if you reasonably believe that the person you are transferring the weapon to is legally allowed to own it (not a Felon, of the appropriate age, not a gang member, etc....)" then you can transfer it without a FFL involved. Also the burden is not actually on you to verify any of this with the other party. He/She, by purchasing the weapon, is in violation if they are not legally allowed to own it.
All that being said, it is some folks policy to see CHL's or Driver's Licenses and in some cases they actually write out a bill of sale with contact info for each party and the signature of each party. Up to you as the seller to handle it any way you want to.
