School vs Pre-school / Public vs Private......

I know, not another "school" thread again. :) Just when I thought I had it figured out, that a school meant K-12, my CHL instructor confused me this weekend. He stated that carrying on any school, public or private, was off limits anytime. :headscratch

The reason I'm asking this question is that I have an interesting situation. My daughter attends a pre-school at my church that has 18 months through K, and is accredited by the state. Is this off limits?

But I also volunteer at the church. I'm up there 3-4 times a week (non-pre-school related reasons) during the day, night, and weekends? Does the pre-school make the entire grounds (buildings) off limits?

There are no 30.06 signs anywhere.

Help, I'm confused....... :)

I understad your concern. My daughter attends a private Christian School located at a church. The school buildings are used by the church on Sundays .
I don't carry in any of the classrooms, and during school events I don't carry in the auditorium.

I cannot give you a definitive answer, sorry.

The term "school" isn't defined in the statute, thus the "common usage" of the term is applied. However, with the term "school," it's clear that K - 12th grade would commonly identify a school (public or private), but what about pre-schools, nurseries and daycare centers that offer instruction? It could be argued that a "pre-school" by its own term is something that precedes a school, but that's on the cutting edge of the law where a person can bleed to death!

This points out the need to define "school" for purposes of TPC §46.03 and §46.035.

I don't want to give any ideas...but if it stays concealed who would know. If you have to un-conceal...then you'd be glad you had it on maybe? Thats what MY train of thought would be, but you have to come to your own decisions.

Since it is an accredited school, I would stay away from the grounds of the school, but being at the church you should be ok.

Nick....it is hard for government to define common sense. People either have it or they don't!
