about what constitutes "finally delinquent" for the purposes of a CHL approval. After waiting on hold for over 30 minutes I finally spoke with an extremely rude lady who was not able to really clear up the question at all.

The summary is this: if you [ever] owe any amount of taxes to any TX government entity that is even one second overdue, then you mighthave your CHL denied or revoked. Or maybe not. Who knows. There is no way to tell. I asked if they could check on it and save everyone the trouble of processing my application and they said "no". There was no definite answer of any kind really. Either I can file the application and take a chance, or wait until after I finish paying.

She did say "as long as you are paying it, then it shouldn't cause a problem. But if you stop paying it, then they may notify DPS and you could get the CHL revoked or denied if it is still in process. So I asked, what do you mean by "stop" paying. Like, I paid on it earlier this month, but I haven't made a payment today. So did I stop paying, or not? That's when the lady began to shout at me and just repeat the same thing over and over only in a much louder voice. I figured I was not going to get any answer so I gave up.

Now maybe the person answering the phone doesn't know the answer. Or maybe they really don't have an answer... maybe if the taxing authority chooses to notify DPS, then DPS denies or revokes the license and DPS themselves don't make the rules or have any discretion. Who knows. I am now just as confused if not moreso.

My gut impulse is to send in the app and roll the dice. My overly-prudent side thinks I should wait until I finish paying this tax bill just to avoid the risk of having to apply twice.

I glanced over the other thread, and didn't see an answer, so how long are you anticipating taking to pay off the taxes? I'd just attack them with a vengeance, and then reward myself for a job well done by sending in my application and associated fees.


Then, I'd go by myself a new gun... with cash.

~3.5 months to pay it comfortably. Quicker if the stock market will pump up a little bit.

I just called the tax assessor's office. They were extremely friendly and helpful, unlike DPS. They are encouraging me to pay it off by July 1 to avoid additional fees but said that they are not going to do anything to try and block my CHL application. They were actually really surprised by this question and they said as far as they know, they have never gotten a request from the DPS to verify property taxes for anyone and they have never been involved in trying to deny or revoke someone's CHL based on delinquent taxes.

So this bolsters my opinion that I should just send it in. :)

As long as you are making an honest effort to pay your taxes (and you are), I can not see how this will effect your CHL application. I just got mine payed off last month. Go for it. :thumbs2:

I think you're good to go. They probably have the tax delinquency in there for people who are years behind on property tax.

that's the impression I get. the county tax assessor didn't think I should have any problems. I'm going to just send it in and see what happens :)

Besides, at the rate things are going, you'll have it payed off long before you get your license.

"Finally delinquent" means the state has written you off; they have no hope of you ever paying your debt in cash or equivalent. When that happens they generally claim your land and sell it at auction. If you still have title to and ownership of the land then you're just late and you should be fine.

"Finally delinquent" gets you tagged at the county clerks office. That's what they check.
It's formally filed paperwork that you would have been notified of, by a process server.
I see you attempted to enter the gray area. It makes them anxious when their gray area is exposed. :lol:

I had a similar question but in regards to child support. Back in December, we went through our child support review hearing which occurs every three years whether I like or not. In previous reviews the new support order was signed promptly by the judge and a new order sent to my place of employment within a week or two so they could start sending the new amount. This last review was different because both my ex and I did the hearing over the phone (in previous years we showed up at the child support office). Anyway, for some reason, our case kept getting pushed back on the docket and the judge did not sign it for nearly a month and a half. Unfortunately, the order was still effective as of that December, which immediately put me into arrears. This concerned me as being in arrears can affect my CHL status. I called both the child support office and DPS. Both told me pretty much the same thing. There is apparently a threshold of $10,000 or 3 months of non-payment (whichever is less). Anything less than that...given that I am on a payment plan…will not affect my CHL. Anything over that, it could affect the CHL…payment plan or not. Anything less than three months behind on payment will not affect my CHL…Being over three months behind in payment could affect it.

All that being said, it is my understanding that DPS does not monitor these things after the initial packet is verified. If the child support office notices that someone is more than three months behind in child support…the child support office will notify DPS (or who ever the authority is for a given license...as this affects more than just CHL licenses) who will then revoke/suspend the CHL. I mention this because maybe you should call the tax assessor’s office and see if they can give you a better idea of their threshold is before suspending licenses.
