Left Out a Record

Post by dburke87 »

Just an FYI, I am in the "Processing Application" stage as I just received my letter with my PIN # a week ago.

When I filled out my application I accidently left out an arrest on my record. It was a DUI (not DWI) charge, which I believe is only a class C misdemeanor, that I was arrested and placed in the 'drunk tank' overnight for. It was around 3 years ago, and to the best of my memory I was given deferred adjudiaction for it, but it is possible it was dropped.

1. Will a DUI charge 3 years ago, whether stated on my application or not, be reason for denial of my CHL?
2. Will failing to state the arrest on my application hinder the DPS process or possibly even prevent me from getting a CHL?

Also, I was just recently (after the application had been sent in) arrested due to an outstanding warrant for failure to pay a seatbelt ticket. I was taken to the sheriff's office and placed in a holding cell until I got to see a judge and was then released after simply pleading guilty to the seatbelt ticket. No new citations were given, and I had no bail/bond. Will this affect my CHL application at all?

Obtain a notarized record inquiry from the County Clerk’s office in the county from where the offence occurred and send it to the DPS. It should say no record of arrest.

I spoke with the county clerk and DPS. I have the record of arrest from them being sent to me shortly. The DPS said that my application has not been assigned to a processor yet, even though my status online is "Processing Application," and if i sent the letter in now it would just float around the office. Go figure. So he said call back about once a week until someone there is assigned to it, then send the letter, and I should be fine. So we'll see.

I managed to make a similar blunder. In 1981 I had a hot check that went to warrant status. I have no memory of it, even after being told it happened. I can picture doing something stupid like that as I was 20 and married with a 3 year old at that time and we were always doing dumb things back then. I had not put it on my arrest record list since I had forgotten about it. No big deal. They made me get a letter from the circuit court of Collin county stating I had no felony convictions. I sent the letter to DPS and all was good.
