Verbage on gun free zones

Post by LedJedi »

Can someone help me locate the actual verbage on the gun free zone requirements? I've looked and can't seem to find the actual legal text.

I was having a rather spirited debate with a friend of mine the other day who was insisting that carrying the barrel, slide and magazine (without frame) into a federal "gun free zone" was still a violation. I'd like to find the legal text and get the definitive answer for myself.

So what you're really wanting is the definition of what a "firearm" is for the federal laws. I know that it is the serial numbered frame, but I can't remember where to find that. I'll see if I can find it for you, but someone else will probably come along first that already has it bookmarked.

Okay, I found it pretty quickly. 18 USC 921. Definitions. (a)
(3) The term “firearm” means
(A) any weapon (including a starter gun) which will or is designed to or may readily be converted to expel a projectile by the action of an explosive;
(B) the frame or receiver of any such weapon;
(C) any firearm muffler or firearm silencer; or
(D) any destructive device. Such term does not include an antique firearm.
Without the frame, your slide assembly and magazine, even fully loaded, cannot be readily converted to expel a projectile by the action of an explosive. Just don't carry the silencer that goes with it! ;-)

The federal "gun free school zone" law is 18 USC 922. Here is one of many versions available on the web:
http://law.onecle.com/uscode/18/922.html

This law does not prohibit possessing gun parts other than the frame, or ammunition.

ahh, yeah, i see that he may have been right about the ammo, but from what I can gather it's not considered a firearm unless you're talking about a frame.

Something that people have to remember about this law is that local police do not arrest for it. The few people who have been charged were referred to a U.S. attorney by local prosecutors after they were arrested for committing a violent crime on school grounds or in a school.

I predict that if anyone is arrested for simply possessing a loaded weapon with 1,000 feet of a school, the NRA would take the case to the Supreme Court, and the law would be overturned. An earlier version was overturned, and the current law was passed during the Clinton administration with the addition of a few words.
