Another "Can I get a CHL?" Thread
After quite a bit of research and getting confused in the end, I wanted to post my own thread and see what the answer is.
I already am aware that I can't get a Texas CHL, so I am looking at a Utah CFP. So my question is strictly for the Utah license and their policies.
In 2006, I was "arrested and fingerprinted" for a street racing charge. I unfortunately decided to take deferred adjudication, and I received 9 months probation and 100 hours of community service. No jail time was served. I successfully completed the probation and paid off the community service.
Since then I have filed for an order of non-disclosure (any entity other than LEO and GOVT are supposedly not able to see it). It was granted of course and I have verified that it was removed from the Civilian Criminal Searches.
I have seen on here and other forums that Utah does not look at D.A. as a conviction, is anyone certain on this or can show me proof of it?

Utah is not as specific as Texas on their qualifications. But, they ARE good about answering the phone.

Is there any way that I can check to see if my criminal history will prevent me from obtaining a concealed firearm permit BEFORE I go through the whole process of applying?Yes. You can come into our office or call by phone and ask to speak with one of the investigators. If you explain to the investigator what type of problem you have had, he can give you a good idea whether you qualify for a concealed firearm permit or not.

Thanks for the quick reply and your overall help on this forum. That is why I am planning on coming to one of your classes if it works out.
I called one of the BCI investigators (the number on your site) and spoke to Lauri (sp) this morning, (if I am not supposed to put names on here, please delete or let me know).
I let her know my full intentions as far as Texas resident getting Utah permit. I simply told her I had a D.A. charge from 2006. She somewhat stopped me and said "No, our policies are more strick than Texas'."
Honestly, it did not sound like she cared to help or get the full story. If you know someone there that you recommend I speak to, let me know.

We were told in the Utah instructors course, and I've confirmed it with Utah BCI later, that a deferred adjudication is not a conviction in Utah. I'm surprised Lauri said that.
Are you saying you are not currently eligible for a Texas CHL, or that you never will be eligible? Was this racing charge in Texas and, if not, was racing a felony in that state?

I will be eligible for Texas CHL in a couple of years due to the whole D.A. thing. I wanted to get the Utah until then, but we still probably renew it since it's cheap.Charles L. Cotton wrote:

Racing charge was in Texas and it was classified as a B Misdemeanor.

Take the Utah class from Crossfire and send it in. yep, it is a misdemeanor anyway, no big deal for utah. I did the utah course with Crossfire, the best i have been to, i highly recommend it.

Laura is not one of the investigators, but she is usually very helpful. Everyone has a bad day once in awhile, so let's give her the benefit of the doubt.
Utah requires you wait 6 years after a DUI, but only 3 years after any other Class B Misdemeanor. Still, they don't consider deferred adjudication as a conviction, so looks like you are OK anyway. If you still want confirmation on that, call BCI back and ask to speak directly with one of the investigators.

One more quick question. On the Utah application, I can truthfully answer "NO" to all questions asked. Would it be neccessary or helpful to include some documentation regarding my incident?
