I may be wrong on this, but I doubt it. I was at Wally World about 11pm doing my grocery shopping. I always go by and check the ammo supply. I have occasionally picked up ammo that would hours later be gone. A couple of young men (20-25) where trying to buy a couple of boxes of .22 rimfire which were on the shelf. The rep called a manager to unlock the ammo cabinet and then said the manager informed her that it was against state law (Texas) to sell ammunition after 10pm. Now, I myslef have purchased ammunition from this very same store after 10pm on a number of occasions. I have never heard of any law in Texas that prohibits the sale of ammunition at any time. I am betting this manager was just a lazy ignorant guy or Walmart has some new screwy policy about ammo sales. Any one hear of any such law? I tried to encourage the young men to call the manager on this issue. Ask for his name and who his boss was, threaten to write a letter to corporate headquarters, etc. They didn't want to mess with it. If I were the one who had been put off, I think I would have dropped the $60 at small claims court to jack them up. Small Claims Court is a great tool. I have always been amazed how friendly, reasonable, accomodating and compliant people or companies can become after the Constable's office drops some paper work on them. BTW Small Claims is now up from a $5,000 limit to $10,000 limit. I was really ticked off and I wan't even the one trying to purchase the ammo.

The manager may be lazy and arrogant, but I don't think there is any law, civil or criminal, that says a business has to sell anything to anyone if they just don't want to.

It may actually be a Walmart policy as I have seen a sign with something to the effect of "No ammunition or firearm sales after 10:00pm" in a Walmart super center (One of the Lubbock stores I think).

Yeah, that's what he should have done. Contacted Walmart's corporate office and gone through small claims court. I'm sure that would have Walmart shaking in their boots. I'm sure Walmart doesn't have a top-notch legal team. I'm sure that would have been time and $$ well spent over a couple of boxes of .22. I guess I should file something because the bartender refused to sell me a beer last night. Sure the law says they can serve til 2am but this bar closes at 1am. But I guess I can go ahead and "jack them up" through Small Claims Court.

In all reality nothing would have come out of all that. You think Walmart cares? They wouldn't have done a thing. So based on your advice the guy would have been out $60 and still have no .22 ammo. Small Claims Court is a great tool, but only for valid purposes.

There was a sign saying no sales after 10 in the Odessa stores. The remodeled and I don't remember seeing it.
I've had them say 9pm, simply because the key carrying clerk wasn't scheduled to work until 10.

There's no law, but I've read on several forums about people having problems getting ammo after 10pm. I think there was a post here recently that detailed the reason...something about the number of mangers available. Anyway, I have bought ammo after 10pm at several local stores.

I'd asked one of the local managers about this a couple years ago. He said it was pretty much nation-wide policy, because of an incident where the customer had gone in late at night at a CA store to buy ammo and promptly proceeded to load up and start shooting.

I can remember it being store policy at the Baytown store for many years, possibly since it opened.

They require that any ammo from behind the counter be checked out through sporting goods, which isn't staffed after 10pm.

I have bought shotgun shells that were displayed in an aisle as they have checked them out up front.

Yes. I've bought a lot of stuff in the electronics section after it "closed" for the day. They leave the section itself open so folks can get the stuff that's out in the open, and there's almost always somebody there who either has the keys or will go get them and sell you whatever you want, even at 2AM.

Just a Walmart Policy. Which they have every right to inforce be it at a single store or on a state or national level.

Just to show the extent of their power -they could even tell folks who take em to court to never step foot on their property again. Imagine the tyranny of it all

My guess, it's up to the local store manager. If it were a "real" policy their computers wouldn't allow checkers to scan the ammo after 10pm...

There is a 24-hr Walmart near my house. I've purchase ammo from that store as late as 1:00 or 2:00 in the morning. I've never been refused ammo purchase after 10:00.
