My bride had a hankering for BWW tonight, and I couldn't help but take a shot of their sign. No sign of the sign shown in the other thread, I looked carefully, and couldn't find their valid TABC sign either. Obviously corporate doesn't have a clue.
You should have seen the guy come out and look to see what I had taken a picture of.
That sign is the standard sign that TABC makes restaurants post if they make <51% of their sales from alcohol. Its not necessarily incorrect, unless BWW doesn't serve alcohol. Then it's another lame attempt at a 30.06.

They do sell alcohol. Where's the Spanish version of that sign, though?

IIRC, it is not required unless they have a major amount of Hispanic traffic. I think they only have to post in one language, no matter what.

The sign posted is not the TABC "unlicensed possession" sign, it's the other one. The TABC "blue" sign (and I HAVE checked BWW Plano's license) has TABC's logo prominently displayed.
I waited until we were leaving to take the pic, and then a guy came out to look at the front and see what I had taken the pic of. As he stood there kind of scouring the doors for damage or evidence of some sort of wrong doing, he realized we were sitting right across the parking lot from him, so them he folded his arms and did some nonchalant star gazing while we drove away.
BTW, Grandpa Tony's, across from Love Field in Dallas has a 51% sign behind their four seat bar, in spanish only.
Weapons Warning Sign
[Sections 11.41 and 61.11 AB Code]
Mixed beverage permittees, private club registration permittees, wine and beer retailer’s permittees, brewpub licensees and beer retailer’s on-premise licensees who derive 51% or more of their income from the sale of alcoholic beverages and do not hold a food and beverage certificate must prominently display a sign that gives notice that it is unlawful for a person to carry a handgun on the premises, even if the person is licensed under the concealed handgun law. The sign must appear in contrasting colors with block letters at least one inch in height and must include on its face the number “51” printed in solid red at least five inches in height.
Each off-premise retailer and other retail licensees and permittees not listed in the above paragraph are required to display a sign in a prominent place on the premises which is clearly visible to the public. The sign must be at least 6 inches high and 14 inches wide and in contrasting colors giving notice that it is unlawful for a person to carry a weapon on the premises unless the person is licensed to carry the weapon under the concealed handgun law.
The Commission may require the holder of the license to also display the sign in a language other than English.

Hi Jim -
Not to be argumentative, but it looks the same as most other unlicensed possession signs that I've seen. However, an interesting point I noticed from Keith B.'s post, unlike TX PC 30.06, the law requiring the unlicensed possession signs doesn't specify the exact wording.
Since Grandpa Tony's only has a sign in Spanish, shouldn't it be called "Abuelo Antonio's" ?

I thought that having a CHL means we are in " Licensed Possession" of a firearm? That sign specifically states " Unlicensed Possession". I have seen that sign posted at places like Chipoltle as well due to the fact they sell alcohol.
I may be wrong here, but it seems that sign doesn't apply to a CHL holder. Can anyone confirm that thought?

Exactly! These signs are there merely to inform us what the law is (and tell BGs what they can't do (like "Gun Free Zone" signs). It specifically says, "the UNLICENSED possession of a firearm ..." If you have a license, you're good to go. Another way to word the sign could be, "If you are armed in this establishment, you need to have a license". I'm certain any self respecting BG who doesn't have a license would not enter such a place ...

I was under the impression that the "sign = blue" licensees had to use the official TABC blue sign - I could be wrong - this sign is the one that other retain establishments use.

As AggieDad said, you are correct. There are two signs; unlicensed possession (CHL OK) and 51% (CHL not OK). 51% signs are posted at locations that receive more than 51% of their revenue from alcohol sales for consumption on premise and carry out. Unlicensed possession signs are posted at locations where they receive less than 51% of their revenue from alcohol sales for on premise consumption and/or off-premise carry-out.
Here are examples. On the real signs, the 51% is red and the unlicensed possession sign is light blue.

Jim - I don't see anything wrong with that sign - other than, like mentioned - the blue. It doesn't apply to "us" so to speak.
I think I've posted this before, but the Grapevine BWW posts this silly sign, which, of course, doesn't mean squat to "us":
It's hard to see, it says "Buffalo Wild Wings Inc. bans guns on these premises."
I like the TABC signs, and, like I've mentioned elsewhere, it would be GREAT if there was a 30.06 sign that the State produced/provided - that way there's no question as to the validity of it.

Don't believe the highlighted parts are correct. In order to be a 51% establishment, they must receive 51% or more of their income from ON-SITE-CONSUMED alcohol sales. Specifically, liquor stores, that receive 100% of their income from alcohol sales for OFF-PREMISIS consumption, do not (can not legally) post a 51% sign, as the consumption is not ON-SITE.
Range Rule: "The front gate lock is not an acceptable target." Never Forget.

Actually, the first requirement is on-premise consumption. However, I don't think it has to be all on-premise. If they only make 30% of their income from on-premise, but make another 30% from carry-out, then I believe it is still a 51% establishment.
You are correct that a package store that does not sell for on-premise is not a 51% location, even though the majority of their income is from alcohol sales for off-premise consumption.
